TERMS AND CONDITIONS FOR TENDER CUM AUCTION FOR SALE OF STEEL TANK MOLASSESFROM CO-OPERATIVE & PUBLIC SECTOR SUGAR MILLS

Holders of valid ML4 & ML6 Licence issued by the Government of Tamil Nadu or their duly authorised representatives alone are eligible to participate in the tender cum auction.

ii) EMD should be given in a separate cover with details of Demand Draft and amount.

iii) In case any tenderer / bidder is represented by any agent, a letter of authorisation by the tenderer / bidder mentioning the period of agent / and a xerox copy of the licence of the tenderer / bidder

i) The tenderer / bidder should offer rate per tonne for a minimum quantity of 500 tons per sugar mills .The Tenderers / Bidder may inspect the stock and check up the quality of molasses before quoting the rates. Withdrawal of offer based on quality will not be permitted. In case, the total quantity offered at the highest price is less than the quantity available for sale, the tenderers other than H1 will be given an opportunity to match the H1 rate within 24 hours from the time of finalising the tender for purchasing the balance quantity, if the H1 tenderer does not exercise option to lift the entire quantity at the time of finalisation of tender.

ii) Tender should be submitted in the prescribed form in a sealed cover superscribed as " TENDER FOR STEEL TANK MOLASSES FOR SALE WITHIN THE STATE DUE ON ……..

iii) The tender should be sent either by Registered Post or delivered in person at the Tamil Nadu Coop Sugar Fedn Ltd , Periyar EVR Building, Vth floor, 690 Anna Salai, Nandanam, Chennai-35

v) Those who choose to participate in the auction only, should also fill up the tender format remitting the EMD and submit it in a sealed cover superscribed as " AUCTION FOR SALE OF STEEL TANK MOLASSES DUE ON ……………."

ii) Sealed tenders will be opened after the end of the open auction in the presence of available tenderers / bidders.

ii) The EMD should be remitted by way of Demand Draft favouring Tamil Nadu Coop Sugar Fedn Ltd payable at Chennai.

iv) The EMD remitted for earlier allotment will not be considered for this tender.

vii) The successful tenderers should remit the Security Deposit at the Federation at the rate of Rs.50/- per MT within 3 days of confirmation of tendered quantity and the rate by the Federation.

viii) The EMD and Security Deposit will be refunded only after satisfactory completion of the contract.

i) The Sales Committee shall have power to accept or reject the price quoted by the tenderers / bidders or to negotiate or to fix an open rate or to delete or include any mills in the tender or to increase / decrease the quantity notified and the decision of the committee in this respect will be final.

ii) The sales committee has the right to accept the whole or part of the offer or to reject a part or the whole of the offered quantity at its discretion, without assigning any reason therefor.

In addition to the price accepted , the successful tenderer / bidder shall remit the duties and taxes at the rate applicable at the time of despatches.

i) The purchaser should remit the amount (Price accepted for Steel tank Molasses and duties & taxes ) by way of Demand Draft in favour of mills at the mill's counter during the office working hours of the mills and lift the Steel Tank Molasses within the lifting time mentioned in the Sale Order.

ii) Steel tank molasses will be delivered subject to availability of stock ( as is where is condition) only to the successful tenderers / bidders or his authorised agent at mill site.

i) If the successful tenderer / bidder fails to lift the allotted quantity of steel tank molasses within the stipulated time, the EMD and S.D remitted by them / him, will be forfeited without notice and the quantity sold will automatically lapse and the unlifted quantity if any will be included in the next tender.

ii) In case of failure to lift the Steel Tank Molasses on or before the due date specified in the Sale order, the member factories shall have the right to dispose the same according to their choice and the loss incurred by the factories, if any, on account of differential cost will be recovered from the tenderer / bidder who failed to lift.

iii) In case of failure on the part of the tenderer to remit the amount claimed towards loss within one week from the date of receipt of the claim, the Federation / concerned mill will initiate action to recover the amount of loss sustained by each member mill.

iv) Non removal of allotted quantity of Steel Tank Molasses from the mill's premises will be the conclusive evidence for failure to perform the contract.

i) The Federation reserves the right to sell the unlifted quantity of Steel Tank Molasses in any manner, as it deems fit.

ii) The Sales Committee has the right to accept offers as a whole or in part or to reject them partly or the whole of the offered quantity at its discretion, without assigning any reason therefor.

iv) Unless otherwise stated , the date & time wherever occurs including sale order, means the date or day that will close by ……….

v) The jurisdiction of the court for dispute, if any, arising out of this contract shall be Chennai City only.

Holders of valid actual users Licence issued by the respective State Government or their duly authorised representatives alone are eligible to participate in the tender cum auction.

ii) EMD should be given in a separate cover with details of Demand Draft and amount.

i) The Tenderer / bidder should offer rate per tonne for a minimum quantity of 1000 tons per sugar mills / entire quantity available in a mill whichever is less. The Tenderers / bidder may inspect the stock and check up the quality of molasses before quoting the rates. Withdrawal of offer based on quality will not be permitted . In case, the total quantity offered at the highest price is less than the quantity available for sale, the tenderers other than H1 will be given an opportunity to match the H1 rate within 24 hours from the time of finalising the tender for purchasing the balance quantity, if the H1 tenderer does not exercise option to lift the entire quantity at the time of finalisation of tender.

iii) On acceptance of the tender/bids, the successful tenderer / bidder should submit the following documents :

¨ Original Import permit and NOC from the Excise Authorities of the concerned States

¨ Certificate from the authorities concerned that the Tenderer/bidder is the exporter of Steel Tank Molasses.

¨ Undertaking by the tenderer/bidder to the effect that excise verification certificate will be obtained from the excise authority and submit to the Mills within the period mentioned in the export permit. Failure to produce the above documents will lead to forfeiture of EMD.

Administrative service fee of Re.200/- per MT is leviable for export of Steel Tank Molasses besides other statutory levies at the rates applicable at the time of despatches.

i) The purchaser should remit the amount (Price accepted for Steel Tank Molasses and duties, taxes and other levies ) by way of Demand Draft in favour of mills at the mill's counter during the office working hours of the mills and lift the molasses within the lifting time mentioned in the Sale Order.

ii) Steel tank molasses will be delivered subject to availability of stock (as is where is condition ) only to the successful tenderer / bidder or his authorised agent at mill site.

i) If the successful tenderer / bidder fails to lift the Steel Tank Molasses within the stipulated time, the EMD remitted by them / him, will be forfeited without notice and the quantity sold will automatically lapse.

Holders of ML-2 Licence for possession and sale for export issued by the Tamil Nadu State Government or their duly authorised representatives alone are eligible to participate in the tender cum auction.

ii) EMD should be given in a separate cover with details of Demand Draft and amount.

i) The Tenderer / bidder should offer rate per tonne for a minimum quantity of 1000 tons per sugar mills / entire quantity available in a mill whichever is less. The Tenderers / bidder may inspect the stock and check up the quality of molasses before quoting the rates. Withdrawal of offer based on quality will not be permitted. FROM CO-OP & PUBLIC SECTOR SUGAR MILLS IN TAMIL NADU

Actual exporter who have experience in the export of sugar / other commodities are eligible to participate in the Tender.

I Tender conditions signed in every page affixing the seal of the company in token of acceptance of the terms and conditions.

ii Xerox copy of import - export code certificate issued by the Director General of Foreign Trade.

iv EMD of Rs.10/- per MT by way of DD ( in a separate cover ) in favour of Tamil Nadu Coop Sugar Fedn Ltd

v A statement showing the details of export order executed in the past two years with the suitable documentary evidence.

I The tenderers should offer rate per tone for a minimum quantity of 500 tons for each sugar mill.

ii Tenders should be submitted in the prescribed form in a sealed cover superscribed as " TENDER FOR EXPORT OF SUGAR DUE ON …………. "

The Tender will be opened by the Export Committee at…… on……..……in the presence of tenders.

v The successful tenderers should remit the Security Deposit at 2% of the total value of the order by way of DD / Bankers cheque in favour of Tamil Nadu Coop Sugar Fedn Ltd within 7 days from the date of allotment order.

vi The EMD will be refunded only after the satisfactory fulfillment of the contract. In the case of unsuccessful tenderers, the EMD will be refunded immediately after the tender is approved by the Director of Sugar

vii The Security Deposit will be refunded after satisfactory completion of lifting the ordered quantity from the respective sugar mills and after submission of proof of export and other documents required.

Price should be quoted for ex-factory delivery excluding duties and taxes as applicable. The mill's scope is only upto loading of sugar in the lorries at the sugar mill's godown. Transport and ocean freight subsidies announced by the Government of India will be claimed by the mill and reimbursed to the tenderer on receipt from the Government of India . For this purpose, the tenderers should produce all necessary documents, failing which, the mills is not responsible for reimbursement of the subsidies. 2% service charges will be recovered from the amount of subsidies at the time of payment.

Packing of sugar in 50 kilo HDPE bags ( to be supplied by the tenderers free of cost ) will be done by the mills at their cost.

Tenderers have to make their own arrangement for transit insurance at their cost and the mills will not take any responsibility for the quality or quantity once the goods leave the mills premises.

The tenderers can inspect the quality of the sugar and satisfy themselves of the above specification before quoting. The goods so quoted alone will be delivered to the tenderers on " as is where is condition " . Rejection will not be accepted on quality once the goods are earmarked to the tenderers and removed from the stock of the mills.

The exporters should lift the entire allotted quantity of sugar from the mills concerned within 45 days from the date of receipt of firm orders from the Federation. If there is any delay beyond 45 days, the allotment order will be cancelled and the mill will be at liberty to dispose of the contracted quantity in open market and in that event, the loss by way of differential price and other expenses will be recovered from the tenderers.

The tenderers should execute an agreement with individual sugar mill in a non-judicial stamp paper valued at Rs.10/- within 7 days from the date of issue of sale order by the Federation.

I The tenderers should submit the proof of export and other documents as may be required by the mill.

ii If the goods lifted for export is not actually exported, the tenderer is solely responsible for all the consequences and losses and also answerable to the authorities concerned.

The Export Committee shall have power to accept or reject the price quoted by the tenderers or to negotiate or to fix an open rate or to delete or include any mills in the tenders or to increase / decrease the quantity notified and the decision of the committee in this respect will be final.

The export committee has the right to accept the whole or part of the offer or to reject a part of the whole of the offered quantity at its discretion, without assigning any reason therefor.

The contract is at all times subject to the Government of India rules and regulations regarding export of sugar. The tenderer is responsible to obtain release order from the Government of India for the quantity to be exported.

For any dispute arising out of this contract, the jurisdiction will lie with the Court in whose territory the mills is located.
