PROCEDURE- Master Plan Variations


Change of Landuse Proposals


Application in 3 sets  should be submitted to the Member Secretary in the case of Composite Local Planning Authorities and to the Regional Deputy Director of Town and Country Planning in other cases. The application set should consist of : 3 sets

    • (Application form for Master Plan Change of land use) As per Check list.
    • As per check list Listed enclosures (enclosures to accompany change of land use applications)  
    • Prescribed charges  (publication and republication charges for Master Plan Change of Landuse Rs. 2500/- for LPA fund & 4000/- Publication Charge Member Secretary or RDD as the case may be will send two sets to the local body concerned for scrutiny and for remarks / recommendation.

Member Secretary, Local Planning Authority / NTDA/RDD  will call for objections and suggestions on the proposed change of land use  through local daily news papers both in Tamil and English  allowing 30 days for response.

    • Member Secretary / Regional Deputy Director may call for further remarks or return the proposal for want of complete details.

After 30 days from the date of calling for Objections and Suggestions,  with the remarks based on the   Objections and Suggestions and site inspection proposal Member Secretary of LPA/NTDA or the Regional Deputy Director will forward  to DTCP.

  • At the Directorate, after due scrutiny, Commissioner of Town and Country Planning may call for remarks or return  the proposal for want of particulars or reject the same with due remarks.
  • Commissioner may forward the proposal to Government in Housing and Urban development Department with remarks and recommendation
  • Government may call for particulars or return for want of particulars or reject the proposal or approve the change of landuse proposal.
  • MS/RDD will issue appropriate Landuse variation orders under section 32(4) of Tamil Nadu Town & Country Planing Act, 1971 which will be published in the Government Gazette and  republished in the District Gazette
  • After gazette publication LPA/NTDA/RDD will collect the Development Charges and then the planning permission will be issued.

Change of Landuse Proposals – Detailed Development Plan Variations

  • Applicantion  should be submitted in 3 sets to Member Secretary in case of Composite LPAs and to the RDD in other cases. Apllication set should consist : 3 sets
    • As per check list (Application form for DD Plan Change of land use)  
    • As per check list Listed enclosures (enclosures to accompany change of land use applications)  
    • Prescribed charges ( prescribed publication and republication charges for change of landuse in Detailed Development Plan). (Rs. 2500/- (Local body), 4000 Publications charge.
  • RDD/ Member Secretary will call for remarks / resolution of Localbody concerned
  • After scrutiny,  RDD/ Member Secretary  will forward the proposal to DTCP  with remarks based on site inspection along with the  necessary resolutions / remarks of Localbody and LPA.
  • Commissioner of Town and Country Planning may call for remarks/ additional particulars or return or reject the proposal for valid reasons.
  • If satisfied, Commissioner may issue consent and then  the draft variation for  which will be published in the Government Gazette under section 33(1) of Tamil Nadu Town & Country Planing Act, 1971.
  • The Local Planning Authority will republish the draft variation in  
      • i) )In the District Gazette
      • ii) In one or more leading daily news papers (Tamil and English ) of the area.
      • iii) In the office notice board of the District Collectorate/LPA/NTDA/RDD/LB

and call for objections and suggestions if any from the public allowing 60 days time.

  •  After the expiry of said 60 days time period  since republication of the draft variation, the Member Secretary of LPA/NTDA /RDD will submit the proposal to DTCP with remarks on O&S for confirmation of change of land use/variation with due recommendation.
  • Commissioner by   an order of proceedings may confirm or reject the variation / change of landuse under section 33(2) of  the Act which will be published in the Government gazette.
