CHAPTER - 3

LAND REFORMS

The Land Reforms Department deals with the implementation of (1) The Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961, as amended (2) The Tamil Nadu Public Trusts (Regulation and Administration of Agricultural Lands) Act, 1961; (3) The Tamil Nadu Cultivating Tenants Protection Act, 1955; (4) The Tamil Nadu Cultivating Tenants (Payment of Fair Rent) Act, 1956; (5) The Tamil Nadu Agricultural Lands (Record of Tenancy Rights) Act, 1969; (6) The Tamil Nadu Occupants of Kudiyiruppu (Conferment of Ownership) Act, 1971;(7) The Tamil Nadu Rural Artisans (Conferment of Ownership of Kudiyiruppu) Act, 1976; (8) The Tamil Nadu Agricultural Labourers Fair Wages Act, 1969, etc.; (9) Minimum Wages Act for Agricultural Labourers; (10) The Tamil Nadu Agricultural Labourers Welfare Board. To implement these Acts there are six (6) Assistant Commissioners (Land Reforms); One (1) Land Tribunal, presided over by an officer of the rank of District Revenue Officer at Chennai and six (6) Revenue Courts presided over by Special Deputy Collectors. The Principal Commissioner and Commissioner of Land Reforms and the Commissioner and Director of Land Reforms monitor the functioning of these authorities.

2. (i) The surplus lands taken over by the Government under the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961 are being assigned to the landless poor in the order of preference, specified under the Tamil Nadu Land Reforms (Disposal of surplus land) Rules, 1965.

(ii) The following table shows the beneficial impact of the reduced ceiling limits leading to increased availability of surplus lands and increased assignment therein.

TENANCY LAWS

1.The Tamil Nadu Cultivating Tenants Protection Act, 1955 (Tamil Nadu Act 25/55):

As on 31.7.2001, 1751 cases are pending.

2.The Tamil Nadu Public Trusts (Regulation and Administration of Agricultural Lands) Act, 1961 (Tamil Nadu Act No.57/61).

As on 31.7.2001, 11606 cases were pending disposal under this Act. The heavy pendency under Tamil Nadu Cultivating Tenants Protection Act and the Public Trusts Acts is due to the ban imposed by Act 20/97 which prohibited eviction of tenants for non-payment of lease rent till 30.6.1999.

3.The Tamil Nadu Cultivating Tenants (Payment of Fair Rent) Act, 1956 (Tamil Nadu Act No.24/56)

As on 31.7.2001, 639 cases have been disposed of out of 682 cases received under this Act, 43 cases are pending disposal.

4.The Tamil Nadu Agricultural Land (Record of Tenancy Rights) Act, 1969 (Tamil Nadu Act, No.10/1969)

As on 31.7.2001, 5,61,628 persons have been registered as tenants in respect of an extent of 15,57,098 acres.

TAMILNADU AGRICULTURAL LABOURERS WELFARE BOARD

 

The Tamil Nadu Agricultural Labourers Welfare Board has been constituted as per G.O.Ms.No.600, Revenue L.R 1(2) Department dated 27.11.2000. The Hon'ble Revenue Minister is the Chairman of the Board with seven official members and nine members each representing agricultural labourers and land owners. The scheme notification has been published in the Tamil Nadu Government Gazette No.109, dated 9.2.2001. As per the scheme, the agricultural labourers have to pay Rs.100/- as one time contribution. At the same time they are eligible for the benefits like assistance for education, marriage, maternity and accident relief etc. The scheme has been implemented from 9.2.2001 onwards. As on 31.7.2001 6,64,803 persons have been registered as members and an amount of Rs.6,64,78,081 has been collected under this scheme, towards the Welfare Fund.

 

A landless agricultural labourer or agricultural labourer having one acre of wet or 2.50 acres of dry land engaged in direct cultivation, who has attained the age of 18 years and not completed 60 years can enrol as a member under the scheme.

CHAPTER - 4

URBAN LAND TAX

Urban Land Tax Department is functioning under the control and supervision of the Principal Commissioner and Commissioner of Land Reforms and the Commissioner and Director of Urban Land Ceiling and urban land Tax. The Commissioner and Director is also ex-officio Joint Commissioner. There are 5 Assistant Commissioners in Chennai City, Chennai City Belt Area and Coimbatore to implement the provisions of the Act. The Urban Land Tax work in respect of other areas have been entrusted to the Assistant Commissioners of Land Reforms at Madurai, Trichy, Tirunelveli and Erode. The Collectors of the Districts concerned supervise the work. The Tahsildars of the Taluks are designated as Urban Land Tax Officers and they are collecting the Urban Land Tax. The collection work is being reviewed by the Principal Commissioner and Commissioner of Land Reforms with the District Revenue Officers periodically.

2. There are 1,62,265 assessment cases and the total tax assessed is Rs.22.55 Crores as on 31.3.2001. The Demand collection and balance particulars as on 30.6.2001 are as follows.

CHAPTER - 5

URBAN LAND CEILING

The Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978 was implemented in TamilNadu with effect from 3.8.1976

2. The Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978 was repealed by the Tamil Nadu Urban Land (Ceiling and Regulation) Repeal Act, 1999 (Tamil Nadu Act 20/1999) with effect from 16.6.1999. An extent of 1266.68 Hectares of land which were at various stages of acquisition as on the date of repeal of the Act have been released to the Urban Land owners. The repeal act does not affect the lands which were already acquired and possession of which have been taken over by the Government as on the date of repeal, and lands exempted under section 21(1) of the Principal Act.

3. In respect of industries, exemptions were granted under Section 21(1) (a) of the Principal Act for 1044 cases covering an extent of 3310 Hectares 53 ares 97 sq.mts. from the inception of the Act till the date of repeal. Exemption has also been granted under section 21(1) (a) of the Act by the Government in 87 cases covering an extent of 36 Hectares 7 ares 62 sq.mts for public purposes like Hospitals, Cinema Theatres, etc. Exemption was granted in 525 cases covering an extent of 111 Hectares 09 ares 32 sq.mts under section 21(1) (b) of the Act, to the individuals who face undue hardship.

4. On the request of the Railway Department, the Government have issued orders permitting the Railways Department to enter upon an extent of 57,736 sq.mts of excess vacant land in various survey numbers in Velachery village for execution of Metropolitan Transport Project (Railways) (MRTS -Phase -II) between Thirumayilai - Velacherry.

CHAPTER -6

AGRICULTURAL INCOME TAX

Before end of February of the previous year, all assessees shall pay an advance tax for the current assessment year at 80% on the agricultural income derived by him during the said previous year. This advance tax would be adjusted towards the tax due from him during the current assessment year at the end of that assessment year.

When compared to previous year 1999-2000, Agricultural Income Tax Collections has come down substantially from Rs.17.29 crores to Rs.5.17 crores, because of poor market conditions and falling tea prices. 95% of tax collections are from tea crop and falling prices had reduced the tax revenues.

CHAPTER - 8

ABOLITION OF INTERMEDIARIES AND CONVERSION INTO

RYOTWARI TENURES

After Independence, the Government with a view to introducing major agrarian reforms, passed series of Acts and abolished all intermediaries between the Government and the ryots. The details of work in progress and the work completed under the various Acts are as follows:-

(H) COMPENSATION TO LANDHOLDERS

The Tamil Nadu State, under various Abolition Acts, has so far settled 20,316 Estates and Compensation to the tune of Rs.7,81,35,129/- had been paid to the landholders. Similarly Rs.2,63,81,443/- had been paid towards interim payment. Under Section 54(B) of the Tamil Nadu Act XXVI/1948, a sum of Rs.12.5 crores has been set apart for the payment of Compensation to Ex-Landholders of the composite State of Madras (both Madras and Andhra Pradesh) and the matter regarding the final settlement is still under correspondence with Government of Andhra Pradesh.

During the financial year 2000-2001, a sum of Rs.1,00,000/- under "AA". Compensation" and Rs.30,000/- under "AB Interim payment" have been sanctioned.

NATHAM SURVEY

In Natham Survey, the Target under measurement has been achieved in full ( 4467 Sq.km has been measured) A target of 0.60 Sq.km per month per unit is adopted for handing over of records to settlement.
