----- ORDER: In the Government Order first read above orders have been issued that the pension of all retired State Government Pensioners who were in receipt of pension as on 1.10.79 be recomputed under the liberalisedk pension formula irrespective of the date of retirement. In the Government letter thire read above, it has been clarified that the Government servants who got themselves absorbed under public sector undertakings/autonomous bodies prior to 1.10.79 and in case where only a portion of pension has been commuted, the pension will have to be enhanced in accordance with the orders issued in the Government order first read above with effect from 1.10.79 The erstwhile Tamilnadu State Transport Department employees absorbed in the various Transport Corporations are receiving monthly pension from the date of their permanent absorption in the Transport Corporations (i.e. with effect from 1.5.75 or 15.9.75 as the case may be) according to their option as per the orders issued in the G.O. second read above. They are also deemed to have retired from Government service as on the date of their permanent absorption in the Transport corporations. The Tamil Nadu state Retired Transport Employees Association has also represnted that the benefits of the liberalised pension formula may be extended to the pensioners of the erstwhile Tamil Nadu State Transport Department. In G.O.Ms.No.1028, Transport Department dated 23.9.85 orders were issued for the sanction of pensionery benefits (Terminal benefits) to the erstwhile Tamilnadu State Transpoort Department employees who have been absorbed permanently in the various Transport Corporations. One set of the erstwhile Tamilnadu State Transport Department employees who retired from service in the Transport corporations prior to the issue of the Government order second read above, are drawing their monthly pension from the concerned Government Treasuries, These employees are allowed to commute 1/3 of their pension. The other set of employees who retired from service in the Transport corporations after the issue of the Government order second read above are drawing their pension from the respective Transport corporations as astop-gap arrangement and the expenditure incurred by the Transport corporations in this regard is reimbursed to the Transport corporations by the Government. Thes employees are not allowed to commute 1/3 of their pension. 5. The Tamil Nadu State Retired Transport Employees' Association has also represented the Government to issue orders for the sanction of 1/3 commutation of pension to the retired employees of the erstwhile Tamil Nadu State Transport Department who are drawing their pension from the respective Transport corporations also. The representations of the association have been examined by Government in details. There is no difference in the quantum of the pensionary benefits between the two group of employees referred to in para 3 and 4 above in as much as both groups have been paid pension under the Tamil nadu Liberalised pension rules 1960 from the date of their permanent absorption in the State Transport Undertakings. 6. The Government after careful examination have decided to extend the benefits of the liberalised pension formula to the pensioners of the erstwhile Tamilnadu State Transport Department and to allow the concession of 1/3 commutation of pension to the erstwhile Tamilnadu State Transport Department employees who are drawing their pension from the Transport Corporation. 7. The Government direct that the erstwhile Tamil Nadu State Transport Department employees who were absorbed permanently in the Transport Corporations and drawing monthly pension, be entitled for the enhancement of their pension under the liberalised pension formula as per the orders issued in the G.O.Ms.No.397, Finance (Pension)Department, dated:14-6-84. 8. The Government also direct that the erstwhile Tamil Nadu State Transport Department Employees whose pension is paid through the respective Transport Corporations, be allowed 1/3 commutation of pension as in the case of pensioners who are drawing their pension from Government, Treasuries. 9. This order issues with the concurrence of Finance Department vide its U.O.No.1951/BPE/88-1, dated 30-8-88.
