ORDER;

In the Government Order second read above, orders were issued for the payment of Medical Allowance of Rs.15/- pm. to the Government Pensioners. In the Government letter 3rd read above orders were issued tothe effect that the Medical Allowance of Rs.15/- per month sanctioned in the Government Order 2nd read above should not be extended to the pensioners of the erstwhile Tamil Nadu State Transport Department and also to stop the payment of this Medical Allowance to the above category of pensioners, if they were paid such Medical Allowance previously. Accordingly, the payment of above mentioned Medical Allowance was stopped with effect from 1-4-1989 so far as the erstwhile Tamil Nadu State Transport Department Pensioners are concerned.

2.The Tamil Nadu State Transport and Transport Corporations Retired Employees Association represented by its Secretary and President filed Writ Petitions in 4475/91 and 14182/91 in the High Court, Chennai praying for the restoration of the Medical allowance with effect from 1-4-1989 onwards and also to issue Medical Identification card to the erstwhile Tamil Nadu State Transport Department Pensioners.

3. The High Court, Chennai in their judgement dated 2-8-1996 and 1-11-1996 on the above mentioned Writ Petitions had ordered that after having given the benefits, withdrawing the same without any notice to the pensioners is against the principles of natural justice and in such circumstances, the benefit granted to the retired employees need not be taken away on the ground that they ceased to be Government Servants. Accordingly the above mentioned Writ Petitions were allowed with a direction to grant the monetary benefit of Medical Allowance to the petitioners as early as possible.

4. The General Secretary, Tamil Nadu State Transport and Transport Corporation Retired employees Association and Tamil Nadu State Retired Transport Employees Association have also represented the Government to issue orders for the restoration of payment of monthly Medical allowance with effect from 1-4-1989 onwards to the erstwhile Tamil Nadu State Transport Department Pensioners based on the orders of High Court, Chennai on the above mentioned Writ Petitions.

 

5. The Government after careful consideration have decided to implement the orders of High Court, Chennai on the above mentioned Writ petitions, to all the erstwhile Tamil Nadu State Transport Department Pensioners who retired /voluntarily retired etc. after their permanent absorption in the State Transport Undertakings. Accordingly the Government issue the following direction

    1. The erstwhile Tamil Nadu State Transport Department Pensioners who are getting monthly pension for their Government service rendered prior to their permanent absorption in the State Transport Undertakings and subsequently retired on attaining the age of superannuation/voluntarily retired etc. after their permanent absorption in the State Transport Undertakings shall be allowed to draw the Medical Allowancewith effect from 1-4-1989 (or) the date of actual retirement/voluntarily retirement etc.from the State Transport Undertakings whichever is laterat the rates admissible from time to time as per the orders issued in the Government Orders 2nd, 4th and 5th read above and also be eligible for thesubsequent increases if any orderedby Government from time to time in future;
    2.  

    3. They shall also be issued with Medical Identification cards for Free Medicare in Government Hospitals on par with other Government Pensioners;
    4. In respect of the erstwhile Tamil Nadu State Transport Department Pensioners who are still in service in the State Transport Undertakings the said benefit shall be allowed only from the date of their actual retirement on attaining the age of superannuation/voluntary retirement etc. from the State Transport Undertakings;
    5. The Pension disbursing Officer shall ensure the eligibility criteria, while sanctioning the Medical Allowance as aforesaid.

 

6. This order issues with the concurrence of Finance Department vide its U.O.No.3393/FS/P/97, dated:10-7-1997.
