------ ORDER; In the Government Order first read above, Government have passed orders relating to Pension, Gratuity, Provident Fund, Earned Leave, Family Pension and Commutation of pension in respect of Government employees who opt for permanent absorption in the State Owned Corporations/Boards/Undertakings. Consequent on the formation of various Transport Corporations from 1972 onwasrds, the erstwhile Tamil Nadu State Transport Department was wound up with effect from 14-9-75 (afternoon) and all the employees of erstwhile Tamil Nadu State Transport Department were absorbed permanently in the various Transport Corporations based on the option exercised by the employees for such absorption. Eventhough the erstwhile TamilNadu State Transport Department employees have exercised option for their permanent absorption in the Transport Corporations on different dates and were working continuously in the various Transport Corporations with effect from different dates from 1-1-72, the crucial date for their permanent absorption in the Transport Corporations was fixed as 1-5-1975 or the date from which the employees was continuously working in the Corporation whichever was lateras per orders issued in the Government Order second read above. Thecrucial date aldready fixed in the G.O.second read above holds good without any change in this regard. In the G.O.second read above, the Government have issued revised orders on the settlement of Terminal Benefits forthe Government servants who opt for permanent absorption in the State Owned Corporations/Boards. In those orders, it has been stated that it would cover all persons including persons who opted for service under various Transport Corporations. 2. The Government on re-examination of the whole issue, have now decided that in respect of the absorptions of all erstwhile TamilNadu State Transport Department employees in the various Transport Corporations their Terminal Benefitsshouldbe settledas per the orders issued in G.O.Ms.No.378, Finance, dated 18-4-1975 with procedural modifications set-out as below: 3. The Government having examined the issues relating toterminalbenefits afresh,issue the following orders. The employees of the erstwhile TamilNadu State Transport Department who were absorbed in the various Transport Corporations will be given the following benefits:-
PENSION AND GRATUITY In addition to pay in the Public Undertakings, an opted will be entitled to pension/gratuity earned by him in Government service prior to such absoirption as per Madras Liberalised Pension Rules, 1960. They arepermitted to draw their pension/gratuity from the date of their permanent absorption in the Transport Corporations. The arrears of monthly pension from the date of their permanent absorption till date or the lumpsum amount based on the commuted value of pension according to theiroption shall be paid immmediately in respect of retired/legal heirs of the deceased employes. Some of the retired employes were sanctioned and paid pension only from the dates of the actual retirement from the Transport Corporations onattaining the age of superannuation as per the orders issued in the G.O.second readabove. In respect of such cases the arrears ofmonthly pension from the date of absorption to the date of retirement lumpsum amount based on the commuted value after adjusting the monthly pension already received till date according to their option shall be paid to them. In respect of the employees who expired on or after their permanent absorption the legal heirs would have ben paid only Death-cum-retirement gratuity. In such cases, the lumpsum amount based on the commuted value will be paid to the legal heirs, since the payment of monthly pension does not arise. EMPLOYEES WHO ARE IN SERVICE IN STATE TRANSPORT UNDERTAKINGS If the employees opt for lumpsum amount based on the commuted value of pension, theentire amount of pension and gratuity will be paid to them in the form ofNational Savings Certificate. If they opt for monthly pension, the arrears of monthly pension from the date of absorption to till date and gratuity will be paid to them in the form of National Savings Certificate and the current monthly pension will be paid every month. 4. The expenditure towards the settlement of Terminal Benefits referred to para 3 above will be initially made by the respective Transport Corporations and subsequently adjusted against theoutstanding Government loan to the Corporations. 5.PROVIDENT FUND, EARNED LEAVE AND OTHER KINDS OF LEAVE. The orders issued in the Government Order second read above hold good without any change in this regard. 6.FAMILY PENSION I) Since the opteefor permanent absorption in State Transport Undertakings will cease to be a Government servant, the Government liability for Family Pension will ceas The erstwhile Tamil Nadu State Transport Department employees absorbed permanently in the State Transport Undertakings should be allowed pension increase also in their pension besides Dearness allowances, Additional Dearness allowance as applicable from time to time to Government pensioners who retired on that date as per the orders issued in the letter third read above. 7. The Terminal Benefit proposals on the above lines shall be finalised by the Managing Directors of the respective Transport Corporations immediately and forwardedto the Under Secretary to Government, Residuary Works Transport Department for sanction and transmission to the Accountant-General foradmittance and issue of authorisation for paymen 8.The Accountant General is requested to admit the Terminal Benefit proposals received from the Under Secretary to Government, Residuary Works Transport Department and the amount may be arranged to be authorised for payment through the respective Transport Corporations based on the orders issued in para 4 above. Necessary adjustment debiting the Terminal Benefits head and crediting the loan head ofthe respective Transport Corporation will be proposed at the end of every Financial yearby the Under Secretary to Government (Residuary Works) Transport Department periodically. This order issues with the concurrence of Finance Department vide its U.O.No.607/BPE/85-1 dt.23-9-85.
