Government of India have notified two notifications namely Protection of Women from Domestic Violence Act,  2005 and Rules framed there under the Act for carrying out the provisions of the Act. These Act and Rules came into force w.e.f.26th October, 2006. In this connection, it has been proposed to take immediate steps to appoint Protection Officers in each district as per section 8 of the Act and to provide them with necessary infrastructure to enable them to start functioning and to invite application from Service Providers as per Rule 11 of the  protection of Women from Domestic Violence Rules, 2006. Accordingly, in the letter first read above Director of Social Welfare was requested to send necessary proposal for appoint of Protection Officers in each district, and the proposal for framing the Rules based on the notification dated 17.10.2006 issued by Government of India for carrying out the provisions of the Act.

The Director of Social Welfare in the letter second read above  has reported that he has already addressed the District Collectors requesting to send  2 separate panels - one for appointment of Protection Officer and another for selection of Service Providers. This procedure of appointing the Protection Officers from the panel to be sent by the District Collectors will take some time. In this regard he has requested the Government to take necessary action for appointment of District Social Welfare Officers as Protection Officers temporarily as  a stop gap arrangement and to select the Service Providers from the panel to be sent by the District Collectors. He has also requested the Government to issue necessary orders for appointment of District Social Welfare Officers as Protection Officers in their respective jurisdiction in order to implement the provisions of the Act in the Districts as they possess the qualification and experience as required in the notification  (Viz) 3 years experience in Social Sector.

Accordingly, after careful consideration, Government accept the proposal of Director of Social Welfare and appoint District Social Welfare Officers those who have requisite qualification as Protection Officers temporarily as a stop gap arrangement in their respective jurisdiction  as per section 8 of the protection of Women Domestic Violence Act, 2005 (Central Act No.43 of 2005) for implementation of the Act and Rules. They shall exercise their powers under the Domestic Violence Act 2005 and Rules framed there under within their respective jurisdiction until further orders.
