ORDER:-

In the reference read above, the Commissioner of Social Defence has informed that as per Section 2(d)(iii) of Juvenile Justice (Care and Protection of Children) Act, 2000 the child who is mentally challenged, having no one support or look after is a child in need of care and protection.  Under Section 33(i), of Juvenile Justice (Care and Protection of Children) Act, 2000 the child produced before the Child Welfare Committee may be sent to a Children Home for speedy enquiry by a social worker or a Child Welfare Officer.

2. He has also informed that as per Rule 42 of Juvenile Justice (Care and Protection of Children) Rules, 2001, there shall be a Reception unit in every Children Home which shall take care of children pending enquiries before the Child Welfare Committee.  As there is no Reception unit exclusively for mentally defective children, it has been proposed to start Reception Unit for Mentally Challenged (Mentally Retarded) for Boys and Girls through NGO at Chennai for 40 children. Mentally challenged children of all ages pending enquiries  in the Child Welfare Committees at Chennai, Tiruvallur,  Villupuram,  and Ranipet, (Vellore) can be kept in the Reception Unit on the orders of the concerned Child Welfare Committees. It has been proposed to provide    Rs. 400/- p.m. maintenance grant to the reception unit to be started for the mentally retarded boys and girls at Chennai through   NGO for 40 children as a special case as maintaining these special categories of children is very demanding and expensive.

3.  The Government have examined the proposal of the Commissioner of Social Defence and accord sanction to incur an expenditure of Rs.1.60 lakhs (Rupees One lakhs and Sixty thousand only) for Starting a Reception Unit for 40 Mentally Retarded Boys and Girls through NGO in Chennai under Part-II Scheme 2006-2007.

4.  The expenditure shall be debited to the following head of account.

"2235 - Social Security and Welfare - 02. Social Welfare – 106.    Correctional   Services –  I. Non-plan – AD  -  Approved Schools – 09. Grant-in-Aid-01. Grants   for   current   expenditure”

 (DPC.No. 2235-02-106-AD-0912).

5.  This order issues with the concurrence of Finance Department vide its U.O.No.52293/SW/2006, dated 5.9.2006.
