ORDER:

The Micro, Small and Medium Enterprises Development Act,  2006, (Central Act 27 of 2006) which received the assent of the President of India on 16.06.2006  came into force on  2nd October 2006. The main object of the Act is to facilitate the promotion, development and to enhance the competitiveness of Micro, Small and Medium Enterprises in the Country. Under the Act, both the Central and State Governments have to take certain actions for implementation of the Act. On the part of the State Government the following steps have to be taken:-

(i)  As per section 8 of the said Act the micro and small enterprises may file the Memorandum to such authority as the State Government may specify  under sub-section (4) thereof to receive such memorandum;

(ii) As per section 20 of the said Act, one or more  Micro and Small Enterprises Facilitation Councils have to be established by the State Government at such places specified in the Notification.   

(iii)  As per section 21 of the said Act, the Government have to appoint the  members of the said Facilitation Councils and to frame rules indicating the procedure to be followed in the discharge of their functions.

(iv)  As per section 26 of the said Act, officers have to be appointed to carry out the powers and functions entrusted under the said Act.

2. The Industries Commissioner and Director of Industries and Commerce sent necessary proposals covering the above matters for approval of the Government. The Government of India have also sent  the model Rules prescribing the procedure and functions of the Facilitation Councils constituted under section 20 of the said Act etc. for adoption by the State Governments with suitable modifications.

3. The Government after careful examination have decided to

(1) specify the General Managers of District Industries Centres for the districts other than Chennai and the Regional Joint Director of Industries and Commerce, Chennai for Chennai district  as the authorities under section 8(4) of the Act;

(2)  establish the Micro and Small Enterprises Facilitation Councils  at Chennai, Trichy, Madurai and Coimbatore and to appoint members of those Councils.

(3)  appoint the officers to carry out the powers and functions under the said Act.

(4)  frame Rules specifying the composition of the Micro and Small Enterprises Facilitation Councils the manner of filling vacancies of the members and the procedure to be followed in the discharge of their functions by the members of the said Councils.

4. The Government hereby direct that the five appended notifications will be published in an extraordinary issue of the Tamil Nadu Government Gazette dated the 8th December, 2006. The Works Manager,  Government Central Press, Chennai is requested to send 25 copies of the notifications to the Government in the Small Industries Department and 150 copies to the Industries Commissioner and Director of Industries and Commerce, Chennai after publication in the Gazette.

5. The Industries Commissioner and Director of Industries and Commerce is requested to take necessary follow up action to inform and advise all the State level and District level Associations of Small Scale Industries about the salient features of the above Act and also instruct all the General Managers of the District Industries Centres and the Regional Joint Director of Industries and Commerce, Chennai to extend all facilities for the effective  implementation of the Act.
