ORDER:
The Government of Tamil Nadu is committed to provide transparent, secure and speedy services to the prospective entrepreneurs in the State. Towards this end, on 12.4.2002, while replying to the debates on Demand No. 42, Minister (RI) made the following announcement on the Floor of the Tamil Nadu Legislative Assembly:
“On-line Registration of SSI Provisional Certificate: An entrepreneur can now apply for Provisional SSI certificate on-line by visiting Web-site of Small Industries Department.”
2. The Small Scale Industries Provisional Certificate is required to enable the entrepreneurs to apply to the financial institutions for sanction of loan, get statutory clearances from various departments and get power connection from Tamilnadu Electricity Board on priority basis. Every year, nearly 20,000 entrepreneurs approach for issue of SSI Registration certificates.
3. With a view to simplifying the process it has been decided to take advantage of Internet facilities available throughout the State at multiple points such as Browsing Centres for introduction of On-line Registration and issue of Provisional SSI Registration Certificate to the proposed units in the State. The Director of Industries and Commerce, Chennai, in the letter read above, has sent procedures to be followed by the Regional Joint Director of Industries and Commerce, Chennai / General Managers, District Industries Centres / Browsing Centres for implementation of On-line Registration of SSI for approval of Government. The Director of Industries and Commerce has also sent draft Memorandum of Understanding to be executed between the Regional Joint Director of Industries and Commerce, Chennai, General Managers, District Industries Centres and Browsing Centres for approval of the Government and requested the Government to permit the Browsing Centres to collect a sum not exceeding Rs. 50/- (Rupees fifty only) towards Service Charges for each On-line Registration.
4. The Director of Industries has also stated that the National Informatic Centre, Government of India, Chennai has also reported that the software developed for implementing the On-line Registration is fully secured, tested and found to be working satisfactorily and forwarded generated On-line Provisional SSI Registration application and certificate furnished by the National Informatic Centre, Chennai.
5. The Government have carefully examined the matter. The Government approve the procedures specified in the Annexure I to this order and the Memorandum of Understanding in the Annexure II to this order for implementation of On-line Registration and issue of Provisional Small Scale Industries Certificate to the proposed units by the Browsing Centres linking Regional Joint Director of Industries and Commerce, Chennai, General Managers, District Industries Centres and National Informatics Centre, Chennai. The Government also permit the Browsing Centres to collect a sum not exceeding Rs. 50/- (Rupees fifty only) from the entrepreneurs towards service charges for each On-line Registration. The Government also approve the format of generated On-line Provisional Small Scale Industries Registration Application and Certificate as in Annexure III. The Government direct that the robustness of the system and security should be ensured by the National Informatic Centre, Chennai.
6. This order issues with the concurrence of Finance Department - vide its U.O.No. 2789/FS/P/2002, dated 2.8.2002.

Procedures to be followed for implementation of On-Line Registration of Small Scale Industries Provisional Certificate
- 1. The Browsing Centres in the Districts and the Taluk Headquarters with a minimum infrastructure facilities as prescribed by the National Informatic Centre, Government of India shall only be approved by the District Offices. As on date, more than 144 Centres have been approved and it will be increased in due course of time.
- 2. The approved Browsing Centres shall execute the Memorandum of Understanding approved by the Government furnished in the Annexure II to enable the Government Department to take action against the Browsing Centres in case of misuse, deviation, non-compliance of procedures prescribed and to maintain discipline.
- 3. After execution of Memorandum of Understanding by the approved Browsing Centres with the District Officers, the ID No. and Password shall be allotted to them for doing On-line Registration.
- 4. Any entrepreneur who approaches the Browsing Centre for doing On-line Registration should furnish the required data and based on that, On-line Provisional application form with Certificate will be generated by the Browsing Centre.
- 5. The entrepreneur should self-certify the details given in the generated On-line application.
6. After the receipt of self-certified copy of On-line application, the generated On-line Provisional SSI Registration Certificate should be handed over to the entrepreneur by the Browsing Centre.
7. The name and signature of the person who generated the certificate along with the name of Browsing Centre should be indicated by the Browsing Centre.
- 8. Every week the Browsing Centres should send the self-certified copies of the application with certificate to the respective District Offices for verification of records.
- 9. The respective District Offices shall down-load the On-line registration certificates issued by the Browsing Centres every week and compare with the report sent by the Browsing Centres.
- 10. The approved Browsing Centre is permitted to charge not exceeding Rs. 50/- (Rupees fifty only) from the entrepreneurs for each On-line Registration.
11. If any On-line Certificate is issued by the Browsing Centres without the receipt of self-certified copy of the application, it shall be cancelled by the respective District Officer duly giving show cause notice and the cancelled certificate shall be displayed in the web-site.
12. Since the On-line Registration Certificate is issued at State Level, separate Serial Number with six digits ending with "E" i.e. the first number starts with 000001 - E should be adopted.
13.The manual Registration procedure being done by the District Offices should be continued with the existing serial number followed by them to help the entrepreneurs who wish to get the SSI Registration Certificate directly from the District Office.
14.The National Informatics Centre, Government of India, Chennai, have developed the software and created a Web-site with a centralized server installed at Chennai. The Server System is secured and only approved Browsing Centres which have been given individual User ID No. and Password only can access the data base. A document Key Number should be generated for every application and printed on the Certificate for verifying authority by the concerned agencies such as Banks, Tamil Nadu Electricity Board etc.

WHEREAS the Government Of Tamil Nadu introduced a new scheme of On-line registration of Small Scale Industries units and issue of Provisional Small Scale Industries Registration Certificate to such units, through the approved Browsing Centres in the State of Tamil Nadu.
AND WHEREAS the party of the FIRST PART approved the Browsing Centre of the party of the SECOND PART and allotted Identification Number and Pass word for doing on-line registration and issue of Provisional Small Scale Industries Registration Certificate to the proposed SSI units, specified hereunder.
Now this deed witnesses as follows:
(a)The party of the FIRST PART shall have the liberty to change the Pass Word allotted to the party of the SECOND PART at any point of time.
(b) The User Name and Password allotted to the party of the SECOND PART shall be kept as confidential and it shall not be disclosed to any other person or to any other Browsing Centre for doing online registration and issue of Provisional Small Scale Industries Registration Certificate.
(c) The party of the SECOND PART shall ensure that as soon as the online Small Scale Industries Provisional Registration application with certificate is generated, one more copy of the generated application with certificate shall be taken and signature of the applicant unit shall be obtained in the marked place in the original as well as copy of generated application as a self certification of the details given.
(d) The party of the SECOND PART shall ensure that the name of the operator with signature and date, who has generated the On-line Certificate and the receipt of self certified signed copy of the application along with name of Browsing Centre is mentioned in the space provided at the bottom of both On-line Certificates.
(e) The party of the SECOND PART shall ensure that only after the receipt of self certified copy of the application, the generated On-line Provisional Small Scale Industries certificate is handed over to the applicant.
(f) The party of the SECOND PART shall send weekly report containing the list of units with Provisional Small Scale Industries Registration number in respect of On-line registration and Small Scale Industries Provisional Registered Certificate issued by the Centre, to the concerned General Manager, District Industries Centre / Regional Joint Director of Industries and Commerce, Chennai, along with the Self Certificated copy of the generated provisional application with the certificate, on or before Wednesday of the next week.
(g) The party of the SECOND PART shall continue to keep infrastructure facilities required for doing On-line registration as mentioned below:

(h) The online facility is provided by the party of the FIRST PART to the party of the SECOND PART at free of cost.
(i) The party of the SECOND PART shall not collect more than Rs.50/- from an entrepreneur for each certificate generated and issued.
(j) The party of the FIRST PART is not responsible for any loss / expenditure incurred by the party of the SECOND PART towards establishment of online facility and the entire recurring expenditure shall be met by the party of the SECOND PART.
(k) The party of the SECOND PART shall be responsible for any lapses committed or noticed in future, in issuing online registration certificate and the party of the FIRST PART shall initiate penal action against the party of the SECOND PART in respect of lapses committed or noticed.
(l) The party of the SECOND PART shall not indulge in any illegal activities in respect of On-line registration.
(m) The party of the SECOND PART shall receive the entrepreneurs who come for online registration, with courtesy .
(n) The party of the SECOND PART shall maintain a Register which contains the name and address of the unit, line of activity, Proprietor's name, e-mail address and date on which On-line registration certificate issued, receipt of self -certified copy of signature of the person who receives the certificate, for verification by the representatives of Director of Industries and Commerce / General Manager, District Industries Centre, / Regional Joint Director of Industries and Commerce, Chennai.
(o) The change of ownership of the Browsing Centre of the party of the SECOND PART shall be intimated well in advance to the General Manager, District Industries Centre/ Regional Joint Director of Industries and Commerce, Chennai so as to cancel the existing Memorandum of Understanding and to execute new Memorandum of Understanding with the new owner.
(p) The party of the FIRST PART is not responsible for any disruption during the online registration due to failure of Server, breakdown in the telephone network and any other reasons beyond the control of the party of FIRST PART.
(q) The representatives of Director of Industries and Commerce / General Manager, District Industries Centre / Regional Joint Director of Industries and Commerce, Chennai shall inspect the center of the party of the SECOND PART without any prior intimation to verify the On-line services provided by the party of SECOND PART.
(r ) In the event of deviation of any of the above terms and conditions, by the party of the SECOND PART, the party of the FIRST PART shall cancel the permission granted to the party of the SECOND PART for doing the on-line registration and issue of provisional Small Scale Industries registration certificate, without any notice.

In case, self certified copy of the generated application is not received by the Regional Joint Director, Chennai/General Manager, District Industries Centres within one month from the date of generation of the certificate by the browsing centre, this online certificate be cancelled by the Regional Joint Director, Chennai/ General Manager, District Industries Centres and displayed in the web site under intimation to the applicant unit & browsing centre.

In respect of those who furnish wrong information and do manipulations in the online Application Form the action will be taken by the Department and simultaneously online provisional certificate will be automatically cancelled and displayed in the website.

The Applicant unit and the concerned financial institution who provide loan, shall ascertain the eligibility for subsidies and incentives given by the Government, from the Regional Joint Director, Chennai/ General Manager, District Industries Centres.
CONDITIONS:
-
The provisional registration is given to apply for term loan for the proposed project from Financial institutions and to enable the unit to obtain facilities / clearance, etc. required in the pre-production stage.

The provisional registration will automatically lapse at the end of the validity period or the date of commencement of production, whichever is earlier.

If an applicant / unit is unable to set up the unit within the validity period, the applicant has the option to afresh for provisional registration using standard procedure.

The provisional registration is subject to any or all conditions that may be imposed by the Registering Authority.
