ORDER;
In the letter fourth read above, the Chairman and Managing Director, TANSI has requested the Government for inclusion of TANSI under the purview of Section 16(c) of Tamil Nadu Transparency in Tenders Act, 1998 by a specific G.O. and extend the validity of Section 16 (c) by another 3 years or issue an amendment to Tamil Nadu Transparency in Tenders Act, so as to avail the benefit conferred therein.
2. The Government have examined the matter. The provisions of Section 16(c) of the TNTIT Act, 1998, covers Government Orders which were in force as on 1.10.2000 the date on which the Act came into force. As regards TANSI, the concessions given in the Government orders read above stand protected till 30.9.2004 as per the amended Act.
3. In G.O.Ist read above, purchase preference has been given to TANSI for specific items listed below, which are purchased by certain Government Departments.

4. In the G..O. 2nd read above orders have been issued among others that purchase preference be given to Public Sector Undertakings for products and quantities actually manufactured by them upto 50% of the value of goods required by each Department, Undertakings, Boards, even if the Public Sector Undertakings have not participated in the Tender. As TANSI is also a Public Sector Undertaking. TANSI is entitled to have concession.
5. In the G.O.3rd read above Government have permitted Tamil Nadu Electricity Board to procure line materials from TANSI under rate contract system.
6. Instances have come to notice that the above Government orders are not being followed scrupulously by various Government Departments/ Public Sector Undertakings/Statutory Boards etc.
7. The Government therefore reiterate that all procuring entities shall follow the orders as issued in the Government Orders read above in respect of granting purchase preference to TANSI, in as much as they are covered by Section 16(c) of the Tamil Nadu Transparency in Tenders Act, 1998.
4. This order issues with the concurrence of Finance Department vide U.O.No.14898/Sal/2003-1 dated 14.3.2003.
