ORDER: 

The Government direct that the guidelines mentioned below be followed while granting permission under section 37A of the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961 for future utilisation of excess vacant land by industries:

 (1)   The lands allotted by the Government or Government agencies for industrial purposes as also the lands acquired by Government for industrial purposes and handed over to industrial undertakings shall be permitted to utilise the land without any limit under Section 37A of the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961 subject to the condition that the lands shall be used for development of the industries and shall not be sold or transferred.

1. (2)   Industries which have excess vacant land and desire to utilise the same for future expansion will be granted permission to utilise the land, for a period of 10 years at a time subject to the condition that the lands shall not be sold or transferred.
2. (3)   It is also directed that while assessing the excess lands, the Competent Authorities shall give due allowance for provision of cycle stand, moving and parking space for vehicles, employment amenities including auditorium, schools, play grounds, effluent treatment and disposal etc.

Application of an industrial or commercial undertaking under sub-section (1) of section 37-a of the Tamil Nadu Land Reforms (Fixation of Ceiling on Land), Act, 1961 (Tamil Nadu Act 58 of 1961), for permission to hold dor acquire land in excess of the ceiling area.

1.      Name and address of the industrial or commercial undertaking.
2.      The Chief produce or products that are manufactured or dealt with by the undertaking.
3.      The particulars of all lands held or to be acquired by the undertaking. 

 4.      Lands which are used or required for non-agricultural purposes:- 

 5.      Lands for which permission is required 

 6.      Any other Remarks. 

I hereby declare that the particulars furnished in the application are to the best of my knowledge and belief, true and correct. 

I further declare that in the event of the permission applied for being granted, I shall abide by the conditions subject to which the permission is granted and the provisions contained in the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961 (Tamil Nadu Act 58 of 1961) and the rules made thereunder.  I shall also abide such other conditions as the Government may, by general or special order, specify.
