ABSTRACT Tamil Nadu Water Resources Consolidation Project - FOT - Implementation of Tamil Nadu Farmers' Management of Irrigation Systems Act, 2000 - Election to Water Users' Associations conducted in January and February 2004 - Fresh election to be conducted to fill up the left out vacant posts of Presidents and Territorial Constituency Members on 28.08.2004 - Orders Issued Public Works (W2) Department

ORDER: In pursuant of the orders in the Government Order third read above, election was conducted on 24.1.2004, 31.1.2004 and 7.2.2004 in the 19 districts notified in the Government Order first read above to elect the Office bearers for the posts of Presidents and Territorial Constituency Members of the Water Users' Associations. 2. In his letter fourth read above, the Chief Engineer (Operation and Maintenance and Inter State Water) Water Resources Organisation has reported that there are 131 posts of Presidents and 1888 posts of Territorial Constituency Members of Water Users' Associations left vacant since nominations were not filed in those respective places. He has, therefore, requested orders of Government to conduct fresh election on 28.8.2004 to fill up the vacant posts to fulfill the provisions contained in the Tamil Nadu Farmers' Management of Irrigation Systems Act, 2000 and to incur an expenditure of Rs.1 crore in connection with the above election from the unspent amount of Rs.5.00 crores ( Rupees Five crores only ) sanctioned in the GO Ms. No. 467, Public Works Department dated 21.10.2003. 3. In the circumstances, the Government after careful examination accept the request of the Chief Engineer (Operation and Maintenance and Inter State Water) and direct that fresh elections be conducted on 28.8.2004 as per the election schedule given by him to elect office bearers for the left out 131 posts of Presidents of Water Users' Associations and 1888 posts of Territorial Constituency Members in the respective districts as per Sub-section 4 of Section 5 of the Tamil Nadu Farmers' Management of Irrigation Systems Act, 2000. Permission is also accorded for incurring an expenditure of Rs.1.00 crore (Rupees One crore only) from out of the unspent balance amount sanctioned in G O Ms. No. 467, Public Works Department dated 21.10.2003 under the Water Resources Consolidation Project funds. 4. The expenditure of Rs.1.00 crore as permitted at para 3 above shall be debited to
5. New funds will be provided in Revised Estimate/Final Modified Appropriation 2004-2005. Pending provision of fresh funds the Chief Engineer, Operation and Maintenance and Inter State Water is authorised to incur expenditure to the tune of Rs.1.00 crore as permitted at para 3 above. He is also requested to send necessary proposals through Engineer-in-Chief, Water Resources Organisation, Public Works Department to include the above expenditure in Revised Estimate/Final Modified Appropriation 2004-2005 to the Government in Finance department at the appropriate stage. 6. The Chief Engineer (Operation and Maintenance and Inter State Water), Water Resources Organisation is requested to print the required number of the wall posters and brochures carrying the informations about the Farmers Organisation/ Water Users' Association and elections to Water Users' Associations and to distribute among the farmers for wide publicity about the election. 7. The District Collectors concerned are directed to conduct the elections as per provision contained in the Tamil Nadu Farmers' Management of Irrigation Systems Act, 2000 (Tamil Nadu Act 7 of 2001) on the date mentioned in para 3 above. 8. This order issues with the concurrence of Finance Department vide its U O No. 526/(DS(VNP)/2004 dated 06.08.2004 and the Additional Sanction Ledger No. 453.
