As per rule 24-A of the Tamil Nadu Government Servants' Conduct Rules, 1973, no Government Servant shall, except after obtaining a No Objection Certificate from the Government, apply for grant or renewal of passport or undertake trip to a foreign country. While applying for such No Objection Certificate, information regarding the purpose of the visit, the duration of stay and the names of countries proposed to be visited shall be furnished. As per the above rule, the power to issue No Objection Certificate lies only with the Government.
2.In the Government Order read above, the Government have delegated the powers to the Heads of Departments to issue No Objection Certificate to the Government Servants belonging to 'B', 'C' and 'D' Groups to apply for grant or renewal of passport to visit foreign countries as tourists or on pilgrimage or to see friends and relatives or to seek employment. However, the Government retain the powers to issue No Objection Certificate in respect of 'A' Group Officers who apply for passport. Government also retain the powers to issue No Objection Certificate to undertake trips to foreign countries.
3.The Government have, accordingly, decided to amend rule 24-a of the Tamil Nadu Government Servants' Conduct Rules, 1973. The Government have also decided to amend rule 2(3) of Tamil Nadu Government Servants' Conduct Rules, 1973 for classifying Group 'A', 'B', 'C' and 'D' of Government Servants based on their pay scales.
4.The following Notification will be published in the Tamil Nadu Government Gazette :-
NOTIFICATION
In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Government Servants' Conduct Rules, 1973.
2(i) Amendment (1) hereby made shall be deemed to have come into force on the 1st January 1996.
- (ii) Amendment (2) hereby made shall be deemed to have come into force on the 4th December 1997.
AMENDMENT
In the said Rules, -
(1) in rule 2, in clause (3), the Explanation shall be re-numbered as Explanation (2); and before Explanation (2) as so re-numbered, the following Explanation shall be inserted, namely :-
Explanation (1) :- The Government servants holding posts in the Tamil Nadu State and Subordinate Services shall be classified as follows :-
"Group -A: Government servants in posts on pay scales, the minimum of which is Rs.10,000/- and above.
Group - B : Government servants in posts on pay scales, the minimum of which is Rs.5,500/- and above but below Rs.10,000/-.
Group - C : Government servants in posts on pay scales, the minimum of which is Rs.2,610/- and above but below Rs.5,500/-
Group - D : Government servants in posts on pay scales, the minimum of which is below Rs.2,610/-.
The Selection Grade or Special Grade posts shall come under the respective Groups under which the posts in the ordinary grades are classified;
(2) in rule 24-A, after the proviso, the following proviso shall be added, namely :-
"Provided further that the Heads of Departments concerned shall be competent to exercise the powers of the Government under this rule to issue No Objection Certificate to the Government Servants belonging to Group B, C and D who apply for grant or renewal of passport to visit foreign countries as tourists or on pilgrimage or to see friends or relatives or to seek employment.".
