Objection Certificate under Rule 24A of Tamil Nadu Government
Servants’ Conduct Rules, 1973 – Clarifications – Issued.

Rule 24A of the Tamil Nadu Government Servants’ Conduct Rules, 1973 lays down that no Government servant shall, except after obtaining No Objection Certificate from the Government, apply for grant or renewal of passport or undertake any trip to a foreign country.
2. According to rule 9(1) of the Business Rules, the Minister incharge of a department shall be primarily responsible for the disposal of the business pertaining to that department.
3. It has been observed that in many files in regard to grant of No Objection Certificate to Government servants for obtaining passport, orders are issued at the level of Secretary to Government without obtaining orders in circulation to the Minister concerned by the Departments of Secretariat. This is not correct. Eventhough no factors exist against issue of No Objection Certificate like pendency of charges, vigilance enquiries, etc., orders of the concerned Minister will have to be obtained for issue of No Objection Certificate. Orders at the level of Secretary to Government can be issued if the Minister concerned has delegated such powers to the Secretary to Government by means of Standing Orders under the Business Rules.
4. I am, therefore, directed to request you to observe the above procedure while issuing of No Objection Certificate to Government servants.
