ORDER:

The educational qualification prescribed for appointment to the post of Assistant
in  the departments  of  Secretariat  by  the  method  of appointment  by recruitment by transfer from Tamil Nadu Ministerial Service and Tamil Nadu Judicial Ministerial Service is  a  Bachelor's degree.   But while issuing amendments restoring direct recruitment to the post of Assistant in Tamil Nadu Secretariat Service in the G.O.Ms.No.67, Personnel and Administrative Reforms Department, dated 27.3.98, there was an omission of prescribing specific educational qualification against the method recruitment by transfer under rule 14 of the Special Rules for the Tamil Nadu Secretariat Service.  The Tamil Nadu Public Service Commission has pointed out this omission and requested the Government to issue necessary amendments to the Special Rules, as the Commission had already notified the vacancies prescribing the qualification of Bachelor's degree.

2.   As per rule 6 of the Tamil  Nadu Secretariat   Service,  the   crucial  date   for preparation  of  Annual list under the method  of `promotion',  by  transfer   and  recruitment  by transfer,  has  been prescribed as 1st August  of every year,  on  which date the candidate  should have acquired prescribed qualification.  However, the Tamil Nadu Public Service Commission in its Notification dated 23.8.99, announced that the candidates for appointment to the post of Assistant in the Tamil Nadu Secretariat Service to be filled by recruitment by transfer shall possess the educational and technical qualification on the date of the Notification.  In order to validate Commission's Notification, dated 23.8.1999, it is necessary to issue suitable amendments to the Special Rules for the Tamil Nadu Secretariat Service.                                                          

3. The following notification will be Published in the Tamil Nadu Government
Gazette:-

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following amendments to the Special Rules for the Tamil Nadu Secretariat Service (Section 29 in Volume III of the Tamil Nadu Services Manual, 1970).

  2(i)  The amendment (1) hereby made shall be deemed to have come into force on the 23rd August 1999.

(ii)  The amendment (2) hereby made shall be deemed  to  have come into force on  the  19th August 1993.

AMENDMENTS

 In  the said Special Rules,--

(1)  o  rule  6, the  following  proviso shall be added, namely :-

 “Provided that in the case of candidates for selection as Assistant in the departments of Secretariat other than Law and Finance Departments and the Governor’s Secretariat by recruitment by transfer for the year 1999, the date on which the candidates should possess the educational and technical qualifications shall be the 23rd August 1999, namely, the date of Notification of the Tamil Nadu Public Service Commission inviting applications for appointment to the said post."; 

(2)   in rule 14, in the TABLE, in column (3), against the entry "Category-3, Assistants in the Departments of Secretariat other than Law and Finance Departments    and      the    Governor's Secretariat" in column (1) and against the entry "(ii) Recruitment  by  transfer  from  among  the holders of  the  posts of Assistants  and  Junior Assistants  in the Tamil Nadu Ministerial Service and the Tamil  Nadu Judicial Ministerial Service" in column  (2) thereof, for the expression  "(ii) Service for  a  period  of  not  less  than  five years", the following expression shall be substituted, namely :-

"(i)  A  Bachelor's degree;

(ii)  Service  for  a period of not  less  than five years".
