ORDER:-

In the Government D.O.Letter first read above, temporary appointment to the posts of Steno-typists/Typists and Junior Assistants was banned with effect from 25.6.84. In the Government Letters second, third and fourth read above, the ban on temporary appointment to the above posts was lifted with effect from 7.3.86, 12.5.88 and 12.5.89 respectively. Subsequently a total ban for the recruitment of temporary employees through Employment Exchanges for a period of one year from 15.5.91, was imposed in the Government Order fifth read above. The above ban has been continued indefinitely in the Government Order sixth read above. Representations were received from such temporary employees appointed through employment Exchanges, since 1986, to regularise their services straightaway for to conduct a Special Qualifying Test. These temporary candidates have put in service ranging from a few days to a number of years. The Government considered that it would cause read hardship and also affect efficiency adversely if such a large number of persons were thrown out of employment, eventhough under the rules, they have to be replaced by regularly selected candidates through the Competitive Examinations of the Tamil Nadu Public Service Commission.

The Government therefore examined the question in all its aspects and have come to the conclusion that an opportunity may be provided to the temporary employees in the common categories of Junior Assistants/Typists and Steno-Typists who were recruited through Employment Exchanges since 1986 and subsequently ousted from service and for those who were appointed on or before 15.5.91 and continue to be still in service irrespective of the length of service put in by them, for their appointment on a regular basis, subjecting them to Special Qualifying Examination to be conducted by the Tamil Nadu Public Service Commission on the analogy of the decision taken during the years 1977 and 1981.

The Government accordingly pass the following orders:-

All temporary Junior Assistants/Typists and Steno-typists who were recruited through employment Exchanges to the posts which come under the purview of Tamil Nadu Public Service commission, since 1986 and subsequently ousted from service and those who were appointed on or before 15.5.1991 and continue to be still in service irrespective of the length of service put in by them shall be eligible to appear for the Special Qualifying Examination to be conducted by the Tamil Nadu Public Service Commission.

All the temporary candidates, who are successful in the Special Qualifying Examination by securing the minimum qualifying marks shall be absorbed regularly in the vacancies that would arise in the years 1994 and 1995. All the temporary persons who are successful in the Special Qualifying Examination will take rank below the candidates selected on the results of the regular competitive examinations including those held in 1993. If all the successful temporary candidates are not absorbed during 1994 and 1995, the estimates for fresh recruitment will be correspondingly curtailed for the purpose of absorbing the remaining candidates.

Regarding qualifications, all candidates who are educationally and technically qualified for the posts as per the special rules as on date should alone be allowed to appear for the special qualifying examination.

Further the temporary candidates with satisfactory record of service alone shall be eligible for appearing for the special qualifying examination. Each candidate should obtain a certificate in this regard from the Unit Officers under whom he had worked last or is working now.

The examination will consist of two papers, comprising of Essay and General Knowledge as prescribed for Group IV Services and in the pattern of the Special Qualifying Examination already conducted by Tamil Nadu Public Service Commission during 1977 and 1981.

The papers will be in English and the candidates should answer in English in view of the special nature of the examination. The minimum qualifying marks for a pass in the special Examination will be 30% in the aggregate, uniformly for all the candidates, whether belonging to Scheduled Castes and Scheduled Tribes, Backward Classess, Most Backward Classes and De-Notified Communities or others, for bot the papers.

The Examination will be held in Madras only.

Application will be invited by the Commission by a notification in the Tamil Nadu Government Gazette and advertisement in the press, copies of which will be sent to Departments of Secretariat and Heads of Departments and Collectors of Districts. Candidates shall be required to submit one application through the Heads of Office in which they had served last or are now serving and another direct to the Commission. While forwarding the application, the forwarding authorities will be required to furnish a Certificate in the following form:-

Name of Candidate

Description of the Post in which temporarily employed (Junior Assistant or Typist or Steno-Typists) and service in which the post is included.

Particulars of employment with dates.

Whether the candidates' work and conduct have been satisfactory.

Such other information, the Tamil Nadu Public Service Commission may deem necessary.

The Rule of Reservation shall be followed for the purpose of this Special Recruitment.

The question of relaxing the age rule in favour of the successful candidates will be considered by the Government wherever necessary.

The temporary candidates in service who do not appear for the special qualifying examination or who do not come out successful in the said examination shall be ousted from service. This will not bar the ousting of temporary candidates for want of vacancies.

The Tamil Nadu Public Service Commission is requested to conduct the Special Qualifying Examination to the Junior Assistants, Typists and Steno-typists mentioned in para 3 above after the Group IV Main Examination is over.
