In the references cited, it was ordered to regulate the period of absence from duty by Government Employees / Teachers for participating in the illegal strike and reinstated in service as per the orders of the Supreme Court from 1.7.2003/2.7.2003 to 24.7.2003 as Extraordinary Leave Without Pay and Allowances.

2. Employees and Teachers have requested the Hon'ble Chief Minister to take a generous view and to treat the period of absence during the strike from 1.7.2003/2.7.2003 to 24.7.2003 as duty. The principle of "No work No pay" cannot be deviated from. However, considering the extenuating circumstances and the fact that they had already expressed regret in the High Court and their willingness to end the strike and to rejoin duty very early, it has been decided to take a magnanimous view and treat the whole episode of the strike by the employees and teachers as a misguided unfortunate event. In order to ensure that the Government employees and teachers would extend their unstinted cooperation to the Government in all its efforts for the benefit of the poor and the needy, the period from 1.7.2003/2.7.2003 upto and including 4.7.2003 will be treated as "No work No pay". The remaining period upto 24.07.2003 will be treated as duty.

3. Accordingly, Government direct that, in partial modification of the orders issued in the references cited, the period of absence from duty by the Government Employees / Teachers who participated in the strike, shall be regulated as follows:

1)

The period from 1.7.2003 or 2.7.2003 up to and inclusive of 4.7.2003 be regulated as Extraordinary Leave Without Pay and Allowances on the principle of " No Work No Pay "

and

2)

the period from 5.7.2003 up to and inclusive of 24.7.2003 be regulated as duty.
