ORDER:
In the Government order first cited, orders have been issued that the deputation of Government Servants for training abroad should be placed in three categories and bonds obtained as indicated therein. Similarly, in the Government Order second cited, orders have been issued regarding the procedure to be followed in forwarding the applications of the officers trained at the cost of Government within India and the period upto which they are bound to serve the Government after the expiry of the training period. The above orders have been issued to dissuade the officers trained at the cost of the Government from taking up the new job elsewhere, with the result that the expenses incurred by the Government in training the officers becomes at times in fructuous and of no use to Government due to their resignation after training.
2. The above orders have been made more rigid on the interest of the Government by issue of instructions in the references 3rd and 4th read above to the effect that no one should be allowed to go for training / higher studies within India or abroad unless they execute a bond to serve the Government till the date of their superannuation. Orders have also been issued by various administrative departments that if they fail to serve the Government till the date of their superannuation after execution of bond, they should pay to Government a sum of Rs.50,000/- as bond amount.
3. On representation made by various Officers Associations like the Super Specialist Doctors Forum and Association of Engineers, for reduction in the binding period (ie. To work under the Government till superannuation) and the security bond amount, it was examined in consultation with the Advocate General. Orders were issued in the U.O.Note fifth cited, informing the departments of Secretariat that execution of bonds may be dispensed with by Government servants who are deputed for Inservice Training, Seminars, Conferences, Workshops and other Trainings / Studies within India as they are fundamental in nature and their absence treated as ‘duty’. Subsequently a point has arisen as to whether the Government Servants in the Departments of Medicine, Engineering, Agriculture, Education, Animal Husbandry, etc. who undergo higher studies / training within India / abroad at Government cost or at their own cost as the case may be, need be exempted from obtaining such bonds. It was felt that as they are selected for the training / higher study by virtue of their position as Government servants there is no need to exempt them from execution of bonds.
4. The matter was examined in detail and placed before the Secretaries Meeting and in consultation with Law and Finance to evolve a uniform procedure of obtaining bond from the Government Servants for pursuing various Trainings / Higher studies either at the cost of Government or at their own cost within India/ outside India. The Government after careful consideration direct that the procedure of obtaining bonds from the Government servants be followed as appended to this order.
5. These orders shall take effect from the date of its issue.
6.Necessary amendments will be issued by the Administrative Departments concerned to relevant special rules on item (1) in the Appendix and by Personnel and Administrative Reforms (FR.Spl) Department to study Leave Rules under Rule 84 of Fundamental Rules.
7. These orders issue with the concurrence of Law and Finance Departments vide their U.O.No.16782/89, dated 14.6.89 and U.O.No.3274/Fs/P/89, dated 17.8.89 respectively.
