ORDER: 

            In  pursuance  of the directions of the Supreme Court of India in the reference eighth read above, the State Government have formulated a scheme to absorb the retrenched employees of Census Organisation in State Government Local bodies etc.   as was done on earlier occasions by extending the following concessions to them in the Government Order ninth read above:- 

(i) Retrenched employees of the Census Organisation in Tamil Nadu with not less than six months service should be placed in priority (iii) list under Group-III for employment assistance through Employment Exchanges; 

(ii)  A  period of three years is ordered to be excluded in computing their age for appointment through the Tamil Nadu Public Service Commission, the Employment Exchanges and other recruiting agencies, provided that they had  rendered  temporary service of atleast six months in the Census Organisation of this State;  and 

(iii) The rule of reservation shall be followed in making the appointments of retrenched Census employees to the posts for which the rule of reservation is applicable.

2.   While making a review of the above said scheme, the Supreme Court in its judgement dated 28.9.99 has directed to effect certain modifications to the orders issued in the Government Order ninth read above in respect of item (i) and (ii)  in para 1 above.  The operative portion of the judgement is reproduced below:- 

"It would be appropriate for the State Government to delete these two conditions and all that may be insisted upon is that the retrenched employees of the Census Department should be placed in Group IV and the condition relating to the exclusion of  three years from their age shall be deleted.  Subject to this modification, the scheme  proposed by the State Government may be worked out so as to absorb the respondents in services of the State Government or in any of the Local Authority or Government undertakings as may be feasible as expeditiously as possible.  This appeal stands disposed of accordingly".

3.   The Director of Employment and Training was consulted in this matter.  He has stated that the retrenched employees of Census Organisation may be placed in priority (iii) under Group IV for sponsoring candidates against the vacancies arising in State Government, Local Bodies and Public Undertakings.

4.  The Government have therefore decided to implement the directions of the Supreme Court of India.  Accordingly the following modifications are hereby issued to G.O.Ms.No.144, P&AR, dt.  11.8.99.

i) The concessions referred to in items (ii) and (iii) in para 7 of the above said Government Orders are deleted. 

ii)  (a)  All  the retrenched employees of Census Organisation shall be placed in priority (iii) list under Group IV for employment assistance through Employment Exchanges for sponsoring against the vacancies arising in State  Government,  Local bodies and Public Undertakings. 

(b)  The  retrenched  employees  of  Census Organisation shall be exempted from the age limit prescribed in the relevant service rules governing the posts in which they are to be appointed.  This concession shall apply  only  to  the  Retrenched Employees of 1991 Census.
