Sub : Establishment – Secretariat – Certain problems pertaining to Recovery of dues from members of staff of Secretariat.

The Tamil Nadu Secretariat Staff Co-operative Society, is in vogue for the past 69 years catering exclusively to the welfare of the employees of the Tamil Nadu Secretariat. It has been reported that the working of the Society has been turning from bad to worse due to insufficient realization of dues against the demand advised to the pay disbursing officers of the Departments of Secretariat. The monthly deficit as compared between the demand and recovery works out to 42.12%. This predicament may be due to the following reasons :-
- (i) Incorrect certification by the authorized officers about the gross, recovery and the carry home salary of the employees thereby inflating the carry home salary of the individuals to seek maximum loan assistance from the society by excluding certain other recoveries figuring in the acquittance register or otherwise;
- (ii) Pruning the recoveries at their discretion probably on account of persistent pressure of the staff without realizing the legal provisions or their implications in the event of default by the employer as contemplated under the Tamil Nadu Co-operative Societies Act of 1983.
- (iii) Simultaneously applications for salary loan from the staff accompany the certified copy of the same pay slips along with an undertaking for recovering the dues of the Co-operative Urban Banks / Madras Central Co-operative Bank or other agency thereby jeopardizing the loans advanced by the staff society. Such action of the members of the society seeking dual membership in the same class of societies in transgression of section 23(i)(g) of the Tamil Nadu Co-operative Societies Act, 1983.
2. By way of remedial action, I am directed to request you to instruct the pay disbursement officers and the connected subordinate staff to adhere strictly to the following instructions:-
- (i) To furnish correct particulars of the gross salary, all deductions and the correct carry home salary of the employees including the recoveries to be effected for loans borrowed from all other Co-operative instructions like Urban Banks, Tamil Nadu State Co-operative Bank and Madras Central Co-operative Bank and from any other agency.
- (ii) To effect recovery of the demand as advised by the society from the salary payable to the employees of the Secretariat without resorting to reductions in response to the request of the members at their whims.
- (iii) Not to recommend applications for salary loans to Co-operative Banks/ Madras Central Co-operative Bank / Tamil Nadu Co-operative Banks without obtaining a No-Objection/Non-member certificate from the Credit Society exclusively intended for the staff.
