ORDER:-
A large number of persons were appointed temporarily under Emergency Provisions from the Employment Exchange as Junior Assistants, Typist and Steno-typists in various Departments of Government in order to fill up the temporary vacancies that arose between 15.11.1980 and 24.6.1984. On 25.6.1984, Government issued a ban on temporary appointments of candidates from the Employment Exchange. As representations were received from the above temporary personnel working in various Government Departments to regularise their services in view of their long temporary service and substantial experience gained by them, the government with the concurrence of the Tamil Nadu Public Service Commission under the later part of Regulation 16(b) of the Tamil Nadu Public Service Commission Regulations, 1954, issued orders in the Government Order read above regularising the services of all Junior Assistants, Typists and Steno-typists in Tamil Nadu Ministerial Service, Tamil Nadu Judicial Ministerial Service and Typists and Steno-typists in the Tamil Nadu Secretariat Service appointed through Employment Exchange under General Rule 10(a)(i) and who were in temporary service on 25.6.1984 with effect from 25.6.1984 in the same category and in the department in which they were working.
2.Consequent on the ban orders issued by Government, some of the candidates who were appointed in the category of Junior Assistants/Typists/Steno-typists between 15.11.1980 and 24.6.1984 and who were ousted from service on or before 24.6.1984 for want of vacancies lost the chances of getting employment against future vacancies through the Employment Exchange. ;They have represented that many of them had worked temporarily for years together before their ousting on or before 24.6.1984 and because of the ban orders, they could not get either temporary appointment on regular appointment in Government Service. Further, they have also represented that many of them are now over-aged and hence they will not be eligible to write competitive examinations to be held by Tamil Nadu Public Service and requested to the Government to consider their cases for regular absorption in "Government Service on sympathetic grounds.
The Government, through a Press Release dated 13.5.1985, called for particulars of all candidates who were in temporary service between 15.11.1980 and 24.6.1984 and ousted for want of vacancy and could not be absorbed with effect from 25.6.1984 as per Government Order Ms.No.996, Personnel and Administrative Reforms (Placements) Department, dated 22.9.1984. As per the statistics thus gathered through the respective Heads of Departments and Collectors, there are 2,952 Junior Assistants 797 Typists and 102 Steno-Typists who were in temporary service between 15.11.1980 and 24.6.1984 and ousted for want of vacancy. Out of the above persons, there are 414 Junior Assistants, 132 Typists and 31 Steno-typists who had put in temporary service of one year and more during the above said period.
The Government have carefully examined the request made by the above temporary candidates in all its aspects in consultation with the Tamil Nadu Public Service Commission and sought the concurrence of the Tamil Nadu Public Service Commission under later part of the Regulations 16(b) of the Tamil Nadu Public Service Commission 'Regulations, 1954 among other things, for absorbing the candidates who had put in one year and more of temporary service. The Tamil Nadu Public Service Commission has not given its concurrence for the proposal of the Government. The Government consider that the candidates referred to in paragraph 3 above who had put in temporary service of one year and more in the Government order read above as they were not in service on the crucial date, viz. 25.6.1984. The Government, have, therefore, decided to absorb the 577 candidates (414 Junior Assistants, Typists and 31 Steno-typists) mentioned in paragraph 3 above, who had put in a service of one year and more in Government Departments, in future vacancies provided they were fully qualified for the respective posts at the time of their first appointment. The Government accordingly, issue the following orders:-
Abstorption of temporary Junior Assistants/Typists/Steno-Typists:-
(a ) The temporary Junior Assistants, Typists and Steno-typists recruited to Tamil Nadu Ministerial Service in the Government Departments could not reap the benefits conferred Tamil Nadu Judicial Ministerial Service and Typists and Steno-typists recruited to Tamil Nadu Secretariat Service through Employment Exchange under General Rule 10(a)(i) between 15.11.1980 and 24.6.1984 and who had put in service of one year or more, either on or before 24.6.1984 for want of vacancy and whose collectors to the Government along shall be absorbed in Government service regularly in future vacancies, as fresh appointments only and otheir services will be regularised only from the date of their joining in the Department allotted by the Government in future vacancies. The rule of reservation (General Rule 22) shall not apply to these candidates.
The 414 temporary Junior Assistants who had put in temporary service for one year or more shall be absorbed after exhausting the lst of candidates selected through Tamil Nadu Public Service Commission in the year 1986 and who are awaiting postings, provided these candidates were fully qualified at the time of their initial temporary appointment in Government Service.
Regarding Typists and Steno-Typists there are no candidates in the waiting list of Tamil Nadu Public Service Commission. The 132 Typists and 31 Steno-typists who had put in temporary service for a period of one year or more shall be absorbed in the existing vacancies. If the vacancies have already been filled up by getting candidates sponsored by Employment Exchange temporarily consequent on the lifting of the ban in respect of Typists/Steno-typists' the above 132 Typists and 31 Steno-typists can be absorbed in those places by ousting the temporary candidates recruited through Employment Exchange and now working in various Government Departments provided the above Typists/Steno-typists were fully qualified at the time of their initial temporary appointment in Government service.
The list of candidates who had put in a service of one year or more and whose names as already compiled by the Government in 1985, will be communicated to all the Collectors district-wise. The list is subject to verification by the Collectors or other appointing authorities of the conditions of the eligibility of the persons included in the list with reference to the conditions paid down in item (a) above. The publicity by displaying the list in their offices in a prominent place immediately. The Collectors should also communicate the list of these candidates to the various offices in which they worked prior to their ousting, within 7 days of the receipt of this orders and obtain their acknowledgement. The Heads of Offices should be instructed to supply the necessary information in the case of each individual in the form annexed to this order within 20 days from the date of receipt of the letter from the Collector. The Collector should compile the information for the entire district and send the same to Deputy Secretary to Government, Personnel and Administrative Reforms (Co-ordination) Department immediately. As the vacancies of Typists and Steno-typists are to be filled up immediately, priority may be given to compile the information regarding the Typists and Steno-Typists first and the report sent to Government before 31.5.1989. The consolidated list relating to Junior Assistants should be sent to Government before 30.6.1989.
Government in Personnel and Administrative Reforms Department will maintain the consolidated list of candidates of Junior Assistants,Typists and Steno-Typists and allot candidates against the existing as well as future vacancies, subject to the condition laid down in item(a) in paragraph 4 above, according to which in the case of Junior Assistants, allotment will be made only after the list of candidates selected through Tamil Nadu Public Service Commission, 1986, examination maintained by the Tamil Nadu Public Service Commission is exhausted. The vacancies in various Departments should be reported by Collectors to Government as and when they arise. The vacancies in the post of Typists and Steno-Typists already filled up by temporary candidates referred to in item(c) in paragraph 4 above should also be reported to Government with appropriate details.
Allowing of temporary candidates to write Competitive examinations:
7. The Government have also decided that the temporary Junior Assistants, Typists and Steno-Typists who were recruited to Tamil Nadu Ministerial Service, Tamil Nadu Judicial Ministerial Services and Typists and Steno-Typists in the Tamil Nadu Secretariat Service recruited through Employment Exchange Under General Rule 10(a)(i) between 15.11.1980 and 24.6.1984 and who had put in less that one year of service and were fully qualified for the respective post at the time of their first appointment and ousted for want of vacancy on or before 24.6.84 will be permitted to sit in the next regular Group-IV Competitive Examination (S.S.L.C.Standard) to be conducted by the Tamil Nadu Public Service Commission, in relaxation of the age limit prescribed. The Tamil Nadu Public Service Commission is requested to admit such candidates for the examination subject to the production of an eligibility certificate by each such individual obtained from the respective Appointing Authority under whom he served last temporarily.
8. Necessary amendment to Tamil Nadu Public Service Commission Regulations, 1954 for exclusion of posts mentioned in paragrapah 4(a) above from the Commission's purview will be issued separately.
