ORDER :
In the Government Order read above, the Government have directed that the Government servants desirous of securing jobs abroad be permitted to apply through the State Overseas Manpower Corporation and take their chance along with other members of the public and that those who intend to accept the job offers be required to resign from service or be permitted to avail themselves of the provisions of voluntary retirement.
2.In the context of acute pressure for Government employment and existence of surplus staff in some departments it has been considered whether a liberal view may be taken in the matter so as to enable the Government servants go abroad for gainful employment for specified periods.
3.The Government after careful examination have decided to follow a uniform liberal policy in the matter of permitting Government servants irrespective of the categories to which they belong- Technical, non-technical or clerical – to secure and accept jobs abroad and pass the following orders in super session of the earlier orders in the Government Order read above.
- (1) Government employees desirous of seeking jobs abroad, irrespective of categories to which they belong – technical, non-technical or clerical– be permitted to apply and secure employment abroad either through the Overseas Manpower Corporation Limited, or other available sources. However, such of those scares categories of staff/officers whose services are considered essential to this Government shall not be permitted to secure jobs abroad.
- (2) The period of employment abroad shall normally be three years, which can be extended for a further period of two years.
- (3) The period of absence during employment abroad will be treated as extra-ordinary leave without allowance but such period of absence will not be construed as a break in service. It will not be counted for service benefits such as increment, pay, leave, etc. However, if contribution towards pension is paid by the foreign employer or employee such periods will count for pension.
- (4) On return from abroad such officials shall not claim any preference over other in their parent departments for promotion or higher pay by virtue of the experience gained in foreign employment. Nor shall they claim exemption from working experience or other qualifications required under the rules.
4.The Overseas Manpower Corporation Limited of Tamil Nadu will secure maximum employment opportunities abroad for the Government servants. The latter however can secure jobs abroad through other available sources also.
5. The searce categories mentioned in para 3(1) above shall be identified and a list shall be prepared and maintained by each Head of Department with the prior approval of the Government. The list shall be updated from time to time based on the emerging needs and experience.
6.As the absence of the Government servants during the employment abroad is treated as Extra-ordinary Leave without Allowance, the Government direct that the pay of such of those Government servants will be determined with reference to their actual period of duty.
