Abstract

ORDER

 In the G.O. read above orders have been issued for relaxation of Technical qualification to the Personal Clerks for inclusion in the panel of Personal Assistants.  The said order was quashed by Tamil Nadu Administrative Tribunal in its Order O.A.No.1975 of 96, dated 22.9.98.  The persons aggrieved by the said orders of the Tamil Nadu Administrative Tribunal  filed a Writ Petition before the High Court, Madras, and got the orders to stay the preparation of panel for appointment to the post of Personal Assistants in Secretariat.  The High Court, Madras has now given an Interim Order permitting the Government to proceed with the promotion subject to the result of the Writ Petition.  The High Court, Madras has also vacated the stay granted earlier in regard to act upon the orders of Tamil Nadu Administrative Tribunal.  Accordingly, Government have decided to prepare a list of Personal Clerks who are fully qualified for appointment of Personal Assistants  on temporary basis under General Rule 39(a)(i) against the vacancies in the category of Personal Assistants as on 1.8.99. 

2. The Government, therefore, direct that the names of the 43  Personal Clerks indicated in the Annexure to this order be included in the list of Personal Clerks qualified for appointment as Personal Assistant on temporary basis under General Rule 39(a)(i).  Their tentative seniority will be in the order in which their names appear in the list.

  3. The inclusion of the name in the said list and consequently promotion as Personal Assistant are subject to the result of the Writ Petition No.19931 of 98 pending before the High Court, Madras. 

4. The Departments of Secretariat (OP) concerned are requested to display the list on the Notice Board and to communicate the list to all concerned.

  1.      Any person, who wishes to make representation against his / her non-inclusion in the list or regarding seniority shall do so, within a period of three months from the date of issue of this order.  If no representation is received within the said period, the list communicated shall be deemed to be final.
