            Sub :   T.N.G.S.C. Rules, 1973 – Verification by the Prescribed
                        Authority before according permission under Rule 3(1) of TNGSC
                        Rules, 1973 – Instructions – Issued.

            Rule 3 of Tamil nadu Government Servants’ Conduct Rules 1973 lays down that no Government servant shall except with the previous sanction of the Government accept or permit his wife or any other member of his family to accept from any person any gift.

            2.  An instance has come to the notice of the Government, wherein an accused officer who constructed a house in the name of his wife suppressed the fact and applied for permission to the District Collector for acceptance of that house as gift to his wife by his father-in-law. The District Collector had accorded permission to accept this property as a gift to his wife.  The authorities had not made sufficient enquiries before according such permission.

            3.  It has been observed in this connection that even if the fact reported to the District Collector by the individual was correct, the Collector should not have granted permission to the individual as Government are the competent authority to permit a Government Servant to permit his wife to accept any gift under rule 3(1) of the T.N.G.S.C. Rules, 1973.  It has therefore been decided that sufficient verification has to be made by the authorities concerned before recommending such cases to accord permission under T.N.G.S.C. Rules, 1973.

            4.  I am, therefore, to request you to follow the above instructions strictly in future and also issue suitable instructions to the subordinate Officers under your control.
