ABSTRACT

Public Services - Making a provision for appeal to the higher authority or the Government for redressal of grievance against any executive orders passed -Orders issued.

ORDER :

The number of Original Applications filed before the Tamil Nadu Administrative Tribunal, against executive orders by the aggrieved Government servants are on the increase day by day. Section 20 of the Administrative Tribunal Act, 1985 (CA 13 of 1985), provides that a Tribunal shall not ordinarily admit an application unless it is satisfied that the applicant had availed himself of all the remedies available to him under the relevant service rules as to redressal of grievances. In view of the above provision, if an appeal provision is made against executive orders in matters like transfers, etc. where no appeal provision is available in statutory rules, the number of O.As. before the Tamil Nadu Administrative Tribunal could be reduced to a large extent and the Government servants will have the right of appeal to ventilate their grievances before approaching the Tamil Nadu Administrative Tribunal or High Court as the case may be.

2. The Government after careful consideration of the above matter direct that for the redressal of grievances against any executive order, in matters affecting the conditions of service of Government servants, like transfers etc. issued by the Government or by the Competent authority, as the case may be and where no appeal is provided for in any rule in force, an appeal shall lie to the authority next higher to the one who had passed such an order or to the Government, if the order was passed by the Government, within three months from the date of receipt of the order by the appellant.
