ABSTRACT
Public Services - Govt. Employees and Teachers who have participated in illegal indefinite strike from 2.7.2003 - Punishment of dismissal/ reduction in rank/ stoppage of increment for three years imposed based on the orders of the Panel Judges - Reinstatement of Dismissed/ Removed Employees and Teachers and reduction of punishments as per the announcement made by Hon'ble Chief Minister on the floor of the Legislative Assembly on 10.2.2004- Orders issued.

ORDER:
In the Government order first read above, orders were issued to implement, as directed by the Hon'ble Supreme Court of India, the decisions of the Panel Judges recommending exoneration and also the punishments of dismissal, removal, reduction in rank, stoppage of increment with cumulative effect in respect of 2937 dismissed / suspended employees of Secretariat Departments and employees and teachers in the Heads of Departments and their subordinate offices in Chennai City. The punishments of dismissal, removal, reduction in rank, stoppage of increment awarded by the Panel Judges on the employees and teachers except those who were exonerated were implemented with effect from 17.11.2003. Similarly in the Government order second read above, orders were issued to implement the decisions of the Panel Judges in respect of 2771 dismissed / suspended employees and teachers in the Districts. with effect from 31.12.2003.
2. Hon'ble Chief Minister has announced on the floor of the Tamil Nadu Legislative Assembly, on 10.02.2004 that the State Government Employees and Teachers affected by the orders of dismissal, removal, reduction in rank, stoppage of increment have made representations to Government and pleaded for revocation of the punishments on sympathetic grounds. Hon'ble Chief Minister has, therefore, informed on the floor of the House that the Government have decided to pardon these Government employees and teachers and rehabilitate them. Accordingly, Hon'ble Chief Minister announced the following decisions:-
- (i) All the dismissed / removed Government Employees and Teachers shall be reinstated and the punishment be modified as stoppage of increment for four years with cumulative effect.
- (ii) Orders of punishment of reduction in rank imposed on those employees shall be cancelled and consequently the employees of this category shall be restored to their original position. However, they shall be imposed with the punishment of stoppage of increment for two years with cumulative effect.
- (iii) the orders of punishment of stoppage of increment for three years with cumulative effect shall be reduced to one year stoppage of increment with cumulative effect.
3. In the light of the above announcements, the Government issue the following orders:-
( a ) the orders awarding the punishment of dismissals /removals served on all those employees and teachers based on the orders delivered by the Panel Judges as per the direction of the Hon'ble Supreme Court of India for inducing and participating in the illegal strike from 1.7.2003 in respect of Secretariat and from 2.7.2003 in respect of Departments outside Secretariat, shall be modified as a punishment of 'stoppage of increment for four years with cumulative effect. All the dismissed employees and teachers shall be reinstated in service with immediate effect and thereafter the appropriate authority shall impose on them the punishment of stoppage of increment for four years with cumulative effect.
( b) the orders awarding the punishment of reduction in rank served on all those employees and teachers based on the orders delivered by the Panel Judges as per the direction of the Hon'ble Supreme Court of India for inducing and participating in the illegal strike from 1.7.2003 in respect of Secretariat and from 2.7.2003 in respect of Departments outside Secretariat, shall be modified as a punishment of 'stoppage of increments for two years with cumulative effect. The appropriate authority shall issue orders canceling the orders of reduction in rank already served. Thereafter shall impose on them the punishment of stoppage of increment for two years with cumulative effect. The cancellation of punishment of reduction in rank and the stoppage of increment shall be effective from the date of their reinstatement i.e. 17.11.2003 or 31.12.2003 as applicable to the individuals.
(c ) the orders awarding the punishment of stoppage of three increments with cumulative effect on all those employees and teachers based on the orders delivered by the Panel Judges as per the direction of the Hon'ble Supreme Court of India for inducing and participating in the illegal strike from 1.7.2003 in respect of Secretariat and from 2.7.2003 in respect of Departments outside Secretariat, shall be modified as a punishment of 'stoppage of increment for one year with cumulative effect.
4. The appropriate authorities are directed to issue orders of reinstatement in service of dismissed/ removed employees and teachers, orders imposing the reduced punishments in accordance with the directions in paragraph 3 above, immediately.
