ORDER:
With a view to give an opportunity to the temporary employees, who have put in some years of service in the category of Junior Assistants, Typists and Steno-typists for their appointment on a regular basis and providing jobs for those who have been trained and served as youth Service Corps Volunteers, in the Government Orders first and second read above, the Government requested the Tamil Nadu Public Service Commission to conduct a Special Qualifying Examinations of the Degree and S.S.L.C. standards. They were conducted on 8.12.1977 (Degree standard) and 28.12.1977 (S.S.L.C.standard) respectively.
2. In the G.O.third read above it has been ordered that the seniority of the selected candidates will be fixed by the Tamil Nadu Public Service Commission with reference to the marks obtained in the Special Qualifying Examination. With reference to the allotments made by the Tamil Nadu Public Service Commission based on the seniority and choice of candidates for particular departments many have got appointments in offices other than those where they were previously working. According to General Rule 23(a) (i) of the Tamil Nadu State and Subordinate Services the Appointing Authorities have the discretion to appoint a person either from the date of first temporary appointment or from a subsequent date as the case may be. If this provision is invoked and the Appointing Authorities regularise the services of those who were working temporarily in their departments and are allotted to the same departments for regular appointment by the Tamil Nadu Public Service Commission from the dates of their continuous temporary service it will amount to appointing them on a regular basis much earlier than the date of selection for regular appointment itself. Further those who are allotted to different departments where they were not working temporarily will not have the benefit of retrospective regularisation under the above General Rules.
To ensure an uniform procedure in the matter of regularisation of the candidate recruited through the Special Qualifying Examinations 1977 the Government, in consultation with the Tamil Nadu Public Service Commission, issue the following order:-
The services of those who have been allotted to Secretariat Service for appointment as regular Junior Assistants and preferred for such appointment should be regularised from 18.12.77 if they were in temporary service in the Secretariat on that date. If they were not in the Secretariat Service on that date, their services should be regularised from the date on which they joined in the Secretariat Service;
The services of all other candidates – candidates joined as typists and steno-typists in the Secretariat Service and as Junior Assistants, typists and steno-typists joined in the Tamil Nadu Ministerial Service should be regularised from 28.12.77, if they were in temporary service in any department on that date. In other cases, the services should be regularised from the date on which they joined the units to which they were allotted by the Commission.
The services of those who have appeared for degree standard but opted to serve in the Tamil Nadu Ministerial Service shall be regularised from 18.12.77 if they were in temporary service in the Secretariat on that date. If they were in temporary service in any other department on 28.12.77 , or the date of their temporary appointment if they were working temporarily in any department after 28.12.77. In other cases, services shall be regularised from the date on which they joined the units to which they were allotted by the Commission.
Those who are allotted to a different department and joined therein after 28.12.77 will not acquire any right in the former departmental unit where they were working on 18/28.12.77 by virtue of their regularisation of their services from that date. Rules will be amended to this effect separately.
The Government also direct that the candidates selected by the Special Qualifying Examinations shall earn leave at the rate of one-eleventh of the period spent on duty from the dates of their temporary appointment provided the services after those dates are continuous without any break. They are also eligible to surrender earned leave and receive cash allowance in lieu thereof from the dates of their continuous service subject to other conditions for such encashment of earned leave. The unavoidable break in service caused while on joining in the new department after selection by the Tamil Nadu Public Service Commission, will however, be condoned as ordered in G.O.Ms.No.715, Personnel and Administrative Reforms (Placements), dated 6.7.1981.
Wherever tests or training are prescribed for declaration of completion of probation, the candidates are allowed one year to acquire that qualification or undergo the training from the date of this order. If they fail to acquire the qualification within this period, their increments will be stopped for 2 years without cumultive effect and if they fail to acquire the qualification even by the end of the fourth year from the date of this order their services willl be terminated following the normal procedure.
6. In respect of those who do not possess an adequate knowledge in Tamil , they should acquire the qualifications within 4 years from the date of this order. Till then, they will be allowed their normal increments subject to other conditions. If they fail to acquire adequate knowledge in Tamil within the period of 4 years, their services will be terminated following the normal procedure.
7. Amendments to Fundamental Rules, Tamil Nadu Leave Rules and the Service Rules will be issued separately.
