ORDER:-

The following Notification will be published in the Tamil Nadu Government Gazette.

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following rules.

The rules hereby made shall be deemed to have come into force on the 18th December 1977, in respect of the candidates appointed through Special recruitment in 1977 and on the 28th June 1981 in respect of the candidates appointed through Special Recruitment in 1981.

RULES

Short title and applications: These rules may be called the Tamil Nadu Special Recruitments (1977 and 1981) Rules, 1983.

They shall apply to all candidates appointed through Special Recruitments in 1977 and 1981.

2. Decinition: In these rules, unless the context otherwise requires,

"Candidates appointed through Special Recruitment" means the Junior Assistants, typists or Steno-typists appointed to the ‘Tamil Nadu Secretariat Service, Tamil Nadu Ministerial Service or the Tamil Nadu Judicial Ministerial Service through the Special Qualifying Examinations conducted by the Tamil Nadu Public Service Commission.

b. "General Rules" means the General Rules in Part II of the Tamil Nadu State and Subordinate Services Rules;

c. "Special rules" means the Special Rules for the Tamil Nadu Secretariat Service;Tamil Nadu Ministerial Service or the Tamil Nadu Judicial Ministerial Service; as the case may be;

3. Special Provisions: (1) If any of the provisions of these rules are repugnant to the corresponding provisions of the General Rules, Special Rules, Fundmental Rules, Tamil Nadu Leave Rules, 1933 or the Tamil Nadu Travelling Allowance Rule; the candidates appointed through Special Recruitment in 1977 and 1981 shall, notwithstanding such repugnancy, be governed by these rules.

The age and educational qualifications prescribed in the Special rules shall not apply to the candidates appointed through Special Recruitments in 1977 and 1981.

4. Regularisation of services of candidates appointed through Special Recruitment in 1977:-

The services of the candidates who have been allotted through Special Recruitment in 1977 and appointed to the post of Junior Assistant in the Tamil Nadu Secretariat Service, shall be regularised with effect from the 18th December 1977 if they were working temporarily in the said service on the said date:

Provided that if such candidates were not working in the said Service on the said date, their services shall be regularised with effect from the dates on which they were appointed temporarily in the said service subsequent to the 18th December 1977 or with effect from the date of joining duty in the said Service on allotment by the Tamil Nadu Public Service Commission.

The Services of the candidates who have been allotted through Special Recruitment in 1977 and appointed to the post of Typist or Steno-Typist in the Tamil Nadu Secretariat Service and to the post of Junior Assistant,Typist or Steno-typist in the Tamil Nadu Ministerial Service and the Tamil Nadu Judicial Ministerial Service shall be regularised with effect from the 28th December 1977 if they were working temporarily in any department on the said date:

Provided that if such candidates were not working in any department on the said date, their services shall be regularised with effect from the date on which they were appointed temporarily in any department subsequent to the 28th December 1977 or with effect the date of joining duty in any department on allotment by the Tamil Nadu Public Service Commission.

The services of candidates who have appearned for degree standard but opted for appointment to the post of Junior Assistant in the Tamil Nadu Ministerial Service, and the Tamil Nadu Judicial Ministerial Service shall, when such candidates have been allotted and appointed to the said post in the said services, be regularised with effect from the 18th December 1977 they were working temporarily in the Tamil Nadu Secretariat Service on the said date or with effect from the 28th December 1977 if they were working temporarily in other services on the said date.

Provided that if such candidates were not working on the 28th December 1977 their services shall be regularised with effect from the date on which they were appointed temporarily in any department subsequent to the 28th December 1977 or with effect from the date of joining duty in any department on allotment by the Tamil Nadu Public Service Commission.

If any candidate has been allotted to a department other than the department in which he was previously working temporarily or to the same department and joined there in but his service has been regularised from a date earlier than the date of joining duty on allotment by the Tamil Nadu Public Service Commission as provided in sub-rules (1), (2) and (3) such candidate shall not acquire any preferential right in the department in which he was previously working temporarily or in the same department by reason only of such regularisation.

Regularisation of services of candidates appointed through Special Recruitment in 1981:

The services of the candidates who have been allotted through Special Recruitment in 1981 and appointed to the post of Typist or Steno-typist in the Tamil Nadu Secretariat Service and to the post of Junior Assistant, Typist or Steno-typist in the Tamil Nadu Ministerial Service and the Tamil Nadu Judicial Ministerial Service shall be regularised with effect from the 28th June 1981 if they were working temporarily in any service on the said date:

Provided that if such candidates were not working in any service on the said date their services shall be regularised with effect from the date on which they were appointed temporarily in any department subsequent to the 28th June 1981 or with effect from the date of joining duty in any department on allotment by the Tamil Nadu Public Service Commission.

If any candidate has been allotted to a department other than the department in which he was previously working temporarily or to the same department and joined therein but his service has been regularised from a date earlier than the date of joining duty on allotment by the Tamil Nadu Public Service Commission as provided in sub-rule (1) such candidate shall not acquire any preferential right in the department which he was previously working temporarily or in the same department by reason only of such regularisation.

6. Seniority: The seniority of a person in a service, class or category or grade allotted and appointed through Special Recruitments in 1977 and 1981 irrespective of his date of regularisation shall, unless he has been reduced to a lower rank as a punishment, be determined by the rank obtained by him in the list of approved candidates drawn up by the Tamil Nadu Public Service Commission subject to the rule of reservation, where it applies.

7. Fixation of pay:

Every person appointed to the post of Junior Assistant, Typist or Steno-typist shall continue to draw the same pay drawn by him prior to the date of his regularisation if he had been allotted to the same category in the same department where he had been previously working temporarily. The pay of a person allotted to the same category in a different department shall be fixed at the same stage in the time scale of pay applicable to the post of prior to such allotment:

Provided that the above fixation shall not be applicable to a person who was ousted from such temporary appointment in a service for want of vacancies and was appointed in any department on allotment by the Tamil Nadu Public Service Commission. In such cases, the pay shall be fixed at the minimum of the time scale of pay applicable to the post to which he is appointed.

The unavoidable breaks in Services of the candidates appointed temporarily to the post of Junior Assistant, Typist or Steno-typist working in Government departments, caused while on joining duty in a different department on allotment by the Tamil Nadu Public Service Commission, shall be condoned.

The temporary services of Junior Assistants, Typists or Steno-typists as the case may be, prior to the date of regularisation shall count for increment provided such services were continues.

The basic pay of the Junior Assistants, Typists or Steno-typists who were qualified in the Special Qualifying Examinations held in 1977 and who were working in a department but were transferred temporarily to any other department prior to allotment by the Tamil Nadu Public Service Commission shall be fixed with reference to the pay last drawn by them prior to such allotment.

The pay of the candidates who were working in State Government Undertakings on or after the 1st April 1978 and who were allotted and appointed through Special Recruitment in 1977 shall be notionally fixed at the minimum of the time-scale of pay as on the 1st April 1978 if they were working in the said Undertakings on the said date.

Provided that if such candidates were not working in the said Undertakings on the said date, their pay shall be fixed on their appointment allowing notional increments from the dates on which they were working continuously in such Undertakings.

8. Test or training:-

Wherever Test or Training is prescribed as a Qualification for declaration of completion of probation in a service, the candidates shall pass such test or undergo such training within one year from the 12th November 1982 failing which, their increments shall be stopped for two years without cumulative effect. If they fail to pass such test or undergo such training even by the end of the fourth year, their services shall be terminated following the normal procedure.

If any candidate who has been allotted and appointed through Special Recruitments in 1977 and 1981 does not possess an adequate knowledge of Tamil, he shall pass the Second Class Language Test in Tamil conducted by the Tamil Nadu Public Service Commission within four years from the 12th November, 1982. Such candidate shall be granted increments, if but for his failure to pass the said Language Test, he would have declared to have satisfactorily completed his probation. If he fails to pass the said Language Test within the said period of four years, his service shall be terminated following the normal procedure.

9. Earned Leave: The candidates who have been allotted and appointed through Special Recruitments in 1977 and 1981 shall earn leave at the rate of one-eleventh of the period spent on duty from the dates of their temporary appointment provided the services subsequent to such dates are continuous without any break. Such candidates shall also be eligible to surrender earned leave and receive cash allowance in lieu thereof from such dates subject to the other conditions for such encashment of earned leave:-

Provided that they shall cease to earned leave while they have their credit such leave amounting to 180 days.
