ORDER:-

Since most of the erstwhile Town Panchayats were financially weak, and rural in character, the Government decided that the Town Panchayats having a population of less than 30,000 be reclassified as village panchayats so as to enable them to receive more funds from the Government of India and State Government under various grants and assistance. On the proposal of the Director of Town Panchayats based on the 2001 provisional population census figures it was found that out of 611 town panchayats in the State, 568 Town Panchayats were having a population of less than 30,000. Hence a show cause letter was issued by Govt. in the letter first read above, to the Chairmen of the all 568 Town Panchayats requesting to place before the Council and obtain the resolution of the Town Panchayats, why not the notifications constituting the Town Panchayats shall be cancelled, so as to constitute it as a panchayat under the Tamil Nadu Panchayats Act, 1994 narrating the various benefits that will accrue to the Town Panchayats if they are reclassified as Village Panchayats.

2. The Government, after consideration of the resolutions of the said erstwhile Town Panchayats decided to reclassify 566 of them as Village Panchayats and orders were issued in the G.O. second read above accordingly.

3. The Director of Town Panchayats in the letter third read above has now informed the Government that based on the 2001 population census final figures as received from the Director of Census Operation Tamil Nadu, the Village Panchayats of Perambalur in Perambalur District, Thuvakudi in Tiruchirapalli District, Puzhithivakkam in Kancheepuram District, Palladam in Coimbatore District, are having a population of more than 30,000 as detailed below and has requested the Government to constitute them as Third Grade Municipalities:-

4. The Government after careful examination have decided to accept the proposal of the Director of Town Panchayats requesting to constitute the village Panchayats of Perambalur in Perambalur District, Thuvakudi in Tiruchirappalli District, Puzhithivakkam in Kancheepuram District, Palladam in Coimbatore District, which are having a population of more than 30,000 as per 2001 population census final figures as Third Grade Municipalities with effect on and from 05.7.2004 and orders accordingly.

5. By virtue of section 3-MM of the Tamil Nadu District Municipalities Act, 1920, as inserted by the Tamil Nadu District Municipalities (Second Amendment) Ordinance, 2004 (Tamil Nadu Ordinance 8 of 2004), the presidents and members of the said four village panchayats holding office as such before the date of constitution of the said village panchayats as Third Grade municipalities shall be deemed to be the chairmen and members of the Third Grade municipalities and continue to hold office upto the date on which their term of office would expire. All the employees other than the provincialised employees of the said four village panchayats shall be the employees of the Third Grade Municipalities and the provincialised employees shall continue to serve under the Third Grade Municipalities.

6. The appended Notification will be published in the Tamil Nadu Government Gazette Extraordinary, dated the 05th July, 2004.

7. The Collectors of the Districts concerned are directed to cancel the notifications issued by them constituting the said local bodies as Village Panchayats with effect on and from 05.7.2004, and to report to Government.

APPENDIX.

NOTIFICATION.

WHEREAS under the Tamil Nadu Panchayats Act, 1994, (Tamil Nadu Act 21 of 1994), the local areas specified in column (2) of the Schedule below, were constituted as Village Panchayats under the said Act;

And WHEREAS, the Governor of Tamil Nadu having regard to the population in respect of the local areas comprising the village panchayats specified in column (2) of the Scheduled below satisfied that each of the said village panchayats should be classified as transitional areas under the
Tamil Nadu District Municipalities Act, 1920 (Tamil Nadu Act V of 1920);

Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 3-B of the Tamil Nadu District Municipalities Act, 1920 (Tamil Nadu Act V of 1920), the Governor of Tamil Nadu hereby classifies and declares local areas specified in column (2) of the Schedule below as transitional areas for the purposes of the said Act, and under clause (b) of the said sub-section (1) specifies the name of the transitional area as mentioned in the corresponding entry in column (4) thereof and also establishes a Third Grade Municipality for each such transitional area.
