ORDER:

In the Government Order first read above, the employment in Coaching Academics that is to say, Tutorial Colleges, Technical Institutes, Primary or Nursery Schools, English Medium Schools run on Commercial lines without Government grant other than those run by Government and local bodies as the case may be was included in Part-I  of the Schedule  to the Minimum Wages Act, 1948 (Central Act XI of 1948). In the Government Order second read above, the Government appointed a Committee under clause (a) of sub-section (1) of section  5 of the said Act for advising them in the matter of fixing minimum rates of wages for the said employment.  The Committee submitted its report on 29.7.2002.

2. The Government have carefully considered the recommendations of the Committee in the light of the remarks of the Commissioner of Labour and they have decided to fix the minimum rates of wages for the employment in coaching Academics that is to say, Tutorial Colleges, Technical Institutes, primary or Nursery Schools, English Medium Schools run on Commercial lines without Government grant other than those run by Government and local bodies as the case may be.  The Notification appended to this Government Order will be published in the TamilNadu Government Gazette. 

3. The Works Manager, Government Central Press, Chennai-600 079 is requested to publish the appended Notification in English and Tamil in the Tamil Nadu Government Gazette. The Tamil Development, Culture and Religious Endowments (Translation) Department, Secretariat, Chennai-600 009. is requested to supply the works Manager, Government Central Press, Chennai-79 with the Tamil Translation of the Notification.

APPENDIX

NOTIFICATION

In exercise  of the powers conferred by clause (a)  of sub-section (1) of section 3 and sub-section (2) of section 5 of the Minimum Wages Act, 1948 (Central Act XI of 1948), The Governor of TamilNadu, after considering the advice of the Committee appointed under clause (a) of sub-section (1) of section 5 of the said Act, hereby fixes the minimum rates of wages payable to the classes of employees in the employment in coaching Academics, that is to say, Tutorial Colleges, Technical Institutes, Primary and Nursery Schools, English Medium Schools run on commercial lines without Government grant other than those run by Government and local bodies, as the case may be in the State of Tamil Nadu specified in column (1) of the Schedule below, as specified in the corresponding entries in column (2) thereof.

2. This Notification shall come into force with effect on and from the date of publication in the Tamil Nadu Government Gazette.

THE SCHEDULE

Employment in Coaching Academics that is to say Tutorial Colleges, Technical Institutes, primary or Nursery Schools, English Medium Schools run on Commercial lines without Government Grant other than those run by Government and Local bodies as the case may be.

EXPLANATION ;

1. 1)     Classification of Zones : The classification of Zones shall be as follows :-
2. Zone  A, B and C shall comprise  of the following areas:-

2. 2) Dearness Allowance : In addition to the  minimum wages  fixed as above, the employees shall be paid dearness allowance as indicated below:-

(i) The Dearness Allowance is linked to the Average Chennai City consumer Price Index Number for the year 1998, ( Base Year 1982=100)  that is, 425 points and  for every raise of one point over and above 425 points, an increase of Rs.3.00 ( Rupees  Three only)  per month shall be paid as Dearness Allowance.

1. (ii) The Dearness Allowance shall be calculated every year on the 1st April on the basis of the average of the indices for the preceding twelve months that is from January to December.
2. (iii) The first calculation shall be effective from the date of  publication of this Notification  in the Tamil Nadu Government Gazette based on the Average Chennai  City Consumer Price Index for the previous year.
3. (3) Where the nature of the work is the same,  no distinction in the  payment of wages shall be made as between men and women workers.

(4) To arrive at the daily rates of wages, the monthly rates of wages shall be divided by 26.
