ORDER:

As per Section 3(1)(b) of the Minimum Wages Act, 1948, the minimum rates of wages fixed  by the Government in respect of scheduled employments should be revised on such interval which shall not exceed 5 years.

2. In the first meeting of the Southern Regional Committee of Officials of Southern States held on 23.11.2001 at Chennai, it was decided , inter alia, that wherever there is an element of Variable Dearness Allowance for calculation of minimum wages, the period of revision may be fixed as four years and in cases  where there is no element of Variable Dearness Allowance, the period of revision may be fixed as two years.

3. During the 50th meeting of the Minimum Wages (State) Advisory Board, held on 24.9.2003, in which  certain Preliminary notifications revising/fixing Minimum Wages for scheduled employments, placed before the members of the Committee for information and obtaining consent,   the representatives of managements suggested the revision of  Minimum Wages for scheduled employments once in 5 years.

4. The Government have carefully examined this issue in consultation with the Commissioner of Labour and accordingly direct that the periodicity for revision of minimum rates of wages for scheduled employments under the Minimum Wages Act, 1948 shall be once in four years, for which the process shall  start at the end of the third year from the date of initial fixation/last revision.

5.The Commissioner of Labour, Chennai-6 is requested to send necessary proposals to amend the Tamil Nadu Minimum Wages Rules, 1953 suitably.
