ABSTRACT

Labour – Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 – Tamil Nadu Manual Workers Social Security and Welfare Scheme 2001 – Amendments to Scheme – Notified.

ORDER:

The Government established the Tamil Nadu Manual Workers Social Security and Welfare Board on the 17th March, 1999. The Government also established nine Welfare Boards, under sub-section (1) of Section of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982, on the dates noted against each as mentioned below:-

1. Tamil Nadu Auto Rickshaw and Taxi Drivers Welfare Board. 20.7.2000

2. Tamil Nadu Washermen Welfare Board. 20.7.2000

3. Tamil Nadu Hairdressers Welfare Board 20.7.2000

4. Tamil Nadu Tailoring Workers Welfare Board 20.7.2000

5. Tamil Nadu Palm Tree Workers Welfare Board 18.10.2000

6. Tamil Nadu Handicraft Workers Welfare Board 18.10.2000

7. Tamil Nadu Handloom and Handloom Silk Weaving Workers Welfare Board 14.03.2001

8. Tamil Nadu Foot Wear and Leather Goods Manufactory and Tannery Workers Welfare Board 14.03.2001

9. Tamil Nadu Artists Welfare Board 14.03.2001

Schemes have also been formulated in exercise of the powers conferred by section 4 read with Section 3 of the said Act for implementation by the Boards except for the Tamil Nadu Handloom and Handloom Silk Weaving Workers Welfare Board, the Tamil Nadu Footwear and Leather Goods Manufactory & Tannery Workers Welfare Board and the Tamil Nadu Artists Welfare Board. However the workers concerned with employments of above three Boards for which separate schemes were not formulated, are continuously registered with the Tamil Nadu Manual Workers Social Security and Welfare Board and extended benefits. The process of registration of the manual workers in all these Boards is same. The Boards do not have adequate funds to implement the schemes. Implementing same type of schemes by establishing separate Boards/staff involves huge expenditure. The Government, therefore, amalgamated the nine Welfare Boards mentioned above with the Tamil Nadu Manual Workers Social Security and Welfare Board. Consequently, the schemes hitherto implemented by the six out of the nine Welfare Boards have to be implemented by the Tamil Nadu Manual Workers Social Security and Welfare Board. To facilitate this, the Government have decided to issue necessary amendments to the Tamil Nadu Manual Workers Social Security Welfare Scheme 2001.

2. The appended Notifications will be published in the Tamil Nadu Government Gazette, both in English and Tamil.

3. The Tamil Development, Culture and Religious Endowments (Translations) Department, Chennai-600 009, is requested to supply the Tamil version of the Notifications to the Works Manager, Government Central Press, Chennai-600 079.

4. The Works Manager, Government Central Press, Chennai, is requested to send 100 copies of Notification to the Government for reference and record. He is also requested to send 50 copies of Notification to the Commissioner of Labour, Chennai-6, direct.

APPENDIX

NOTIFICATION-I

In exercise of the powers conferred under section 4 read with section 3 of the Tamil Nadu Manual Workers (Regulation of Employment Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982) the Governor of Tamil Nadu after consultation with the Tamil Nadu Manual Workers Social Security and Welfare Board hereby makes the following amendments to the Tamil Nadu Manual Workers Social Security and Welfare Scheme, 2001.

AMENDMENTS.

(1) In the said Scheme,- in preamble, for the expressions "items 6, 10, 11, 18, 24, 32, 35, 36, 43, 45, 51, 52, 54, 59 and 60", the expressions "items 6, 10, 11 and 18" shall be substituted;

(2) In Clause 2, in sub-clause (g) for the expressions "item nos.6, 10, 11, 18, 24, 32, 35, 36, 43, 45, 51, 52, 54, 58, 59 and 60", the expressions "item nos. 6, 10, 11 and 18" shall be substituted;

(3) In Clause 13, after sub-clause (4), the following sub-clause shall be added, namely:-

"(5) Every Officer appointed to collect the contribution under

sub-section (2) of section 8-B of the Act shall collect the same

by cash or by means of a Demand Draft drawn in favour of

the "Secretary, Tamil Nadu Manual Social Security and

Welfare Board", payable at Chennai and remit the same to the

Board within thirty days from the date of such collection

accompanied by a Statement in form V-A";

(4) For Clause 26, the following clause shall be substituted, namely:-

"26. construction of reference to the registration, contribution,

etc. under the Tamil Nadu Manual workers Social Security and

Welfare Scheme, 1999 and other schemes:- (1) Every Manual Worker registered, the contribution made by any manual worker and the contribution made by any employer after

registration and the consequential benefits accrued to any manual worker under the Tamil Nadu Manual Workers Social

Security and Welfare Scheme, 1999, Tamil Nadu Tailoring

Workers Social Security and Welfare Scheme, 2001, 

Tamil Nadu Auto Rickshaw and Taxi Drivers Social Security and

Welfare Scheme, 2001, Tamil Nadu Washermen Social

Security and Welfare Scheme, 2001, Tamil Nadu Hair

Dressers Social Security and Welfare Scheme, 2001,

Tamil Nadu Handicrafts Workers Social Security andWelfare Scheme, 2001, and Tamil Nadu Palm Tree Workers

Social Security and Welfare Scheme, 2001, shall be construed as the registration made, contribution made and the benefits accrued under this Scheme after due registration.’

(2) Where the contribution already paid under various

schemes mentioned in clause (1) by the manual worker if

found to be in excess of the contribution payable under

this Scheme, the excess amount of contribution shall be

refunded to that manual worker after making

necessary adjustment regarding the payment of

contribution or renewal fee, if any, to be paid by such

manual worker.";

(5) after Form V, the following Form shall be inserted, namely:-

NOTIFICATION - II

In exercise of the powers conferred under section 4 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act,1982 (Tamil Nadu Act 33 of 1982) the Governor of Tamil Nadu hereby revokes the following Schemes, namely:-

1. Tamil Nadu Auto Rickshaw and Taxi Drivers Social Security and Welfare Scheme, 2001.

2. Tamil Nadu Washermen Social Security and Welfare Scheme, 2001.

3. Tamil Nadu Hair Dressers Social Security and Welfare Scheme, 2001.

4. Tamil Nadu Tailoring Workers Social Security and Welfare Scheme, 2001.

5. Tamil Nadu Handicrafts Workers Social Security and Welfare Scheme,2001

6. Tamil Nadu Palm Tree Workers Social Security and Welfare Scheme, 2001
