G.O Ms No. 142 Dated 3.11.2005 of Labour & Employment Dept, Tamil Nadu

Factories Act, 1948 and Tamil Nadu Factories Rules, 1950-Site Appraisal Committee as per Section 41-A of the Factories Act, 1948-Reconstituted.

Section 41-A of the Factories Act, 1948 stipulates that the Government may appoint a Site Appraisal Committee for the purpose of advising the Government to consider applications for grant of permission for the initial licence of a factory involving a hazardous process or for the expansion of any such factory.

2. Accordingly, in G.O.Ms.No. 44 Labour and employment Department, dated 7.3.2000, the Government have reconstituted the site appraisal Committee with the term of a period of 5 years and the term of the said Committee expired on 6.3.2005. The Chief Inspector of Factories has, therefore, submitted proposals to the Government to reconstitute the Site Appraisal Committee.

3. In this connection, the Chief Inspector of Factories has stated that the Government have reconstituted the Site Appraisal Committee for a term of 5 years. As the tenure of the committee has expired on 6.3.2005, it is necessary to reconstitute the committee for a further period of 5 years as stipulated under section 41-A of the Factories Act, 1948 read with Rule 61-Q of the Tamil Nadu Factories Rules 1950

4. The Government, after careful examination, have decided to reconstitute the Site Appraisal Committee for a period of 5 years with the following as Chairman and Members:

1.	Chairman	Chief Inspector of Factories.
2.	A representative of the Central Board for Prevention and Control of Water Pollution appointed by the Central Government under Section 3 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)	Environmental Engineer, Central Pollution Control Board, (Ministry of Environment and Forests, Government of India) South Zone Office, 6 West of Chord Road, II Stage, Rajajinagar, Bangalore.560086.
3.	A representative of the Central Board for the Prevention and Control of Air Pollution referred to in Section 3 of the Air (Prevention and Control of Pollution ) Act, 1981 (14 of 1981)
4.	A representative of the State Board appointed under Section 4 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974).	Member Secretary, Tamil Nadu Pollution Control Board, 76,Anna Salai, Guindy, Chennai.600032.
5.	A representative of the State Board for the Prevention and Control of Air Pollution referred to in Section 5 of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981).

8.	An expert in the field of Occupational health.	Joint Director of Public Health and Preventive Medicine (Epidemics), Office of the Director of Public Health and Preventive Medicines, Chennai.600006.
9.	A representative of the Town and Country Planning Department of the State Government.	Deputy Director, (Headquarters) Office of Commissioner of Town and Country Planning, 807, Anna Salai, Chennai.600002.

11.	A representative of the local authority within whose jurisdiction the factory is to be established.	Chief Executive Officer of the Local authority within whose jurisdiction the factory is to be established (to be opted by the committee whenever necessary).
12.	Three other persons as deemed fit by the State Government.	1.Joint Director(Chemicals) Chemical Testing and Analytical Laboratory, Department of Industries and Commerce , Guindy, Chennai.60032. 13.	Member-Secretary.	Additional Chief Inspector of Factories, Office of the Chief Inspector of Factories, Chepauk, Chennai.5.

5. The above Committee shall be treated as a First Class Committee for the purpose of Travelling Allowance/Daily Allowance. The travelling allowance Bills of non-official members will be countersigned by the Additional Chief Inspector of Factories, Office of the Chief Inspector of Factories, Chennai.5.
