ORDER:

Section 41-A of the Factories Act, 1948 stipulates that the Government may appoint a Site Appraisal Committee for the purpose of advising the Government to consider applications for grant of permission for the initial licence of a factory involving a hazardous process or for the expansion of any such factory.

2. Accordingly, in G.O.Ms.No. 44 Labour and employment Department, dated 7.3.2000, the Government have reconstituted the site appraisal Committee with the term of a period of 5 years and the term of the said Committee expired on 6.3.2005. The Chief Inspector of Factories has, therefore, submitted proposals to the Government to reconstitute the Site Appraisal Committee.

3. In this connection, the Chief Inspector of Factories has stated that the Government have reconstituted the Site Appraisal Committee for a term of 5 years. As the tenure of the committee has expired on 6.3.2005, it is necessary to reconstitute the committee for a further period of 5 years as stipulated under section 41-A of the Factories Act, 1948 read with Rule 61-Q of the Tamil Nadu Factories Rules 1950

4. The Government, after careful examination, have decided to reconstitute the Site Appraisal Committee for a period of 5 years with the following as Chairman and Members:

A representative of the Central Board for Prevention and Control of Water Pollution appointed by the Central Government under Section 3 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)

5. The above Committee shall be treated as a First Class Committee for the purpose of Travelling Allowance/Daily Allowance. The travelling allowance Bills of non-official members will be countersigned by the Additional Chief Inspector of Factories, Office of the Chief Inspector of Factories, Chennai.5.

The term of the site Appraisal Committee shall be five years.

The expenditure on account of Travelling allowance/daily Allowance shall be debited to:-

"2230 Labour and Employment -01. Labour-102. Working Conditions and Safety-I. Non-Plan-AE. Setting up of Safety Cells-04. Travel Expenses."

6. This order does not require the concurrence of the Finance Department-vide G.O.Ms.No. 1177, Finance (Allowances-I) dated 19.9.1973.
