ORDER:

In the reference 1st read above, the proposal of the Commissioner of Tourism at an estimated cost of Rs.40.00 lakhs towards the construction of Yatriniwas at Elagiri, Vellore District with the Central Assistance of Rs.30.00 lakhs and the State share (Panchayat Fund) of Rs.10.00 lakhs was forwarded to the Government of India for getting financial assistance.

2. Government of India in their reference 3rd read above conveyed the sanction of the President of India for incurring expenditure not exceeding Rs.40.00 lakhs (Rupees Forty lakhs only) for incurring an expenditure of Rs.30.00 lakhs being the Central share for the project. The balance of Rs.10.00 lakhs shall be borne by the Government of Tamil Nadu through Elagiri Panchayat Fund of Vellore by the District Collector, Vellore District. Government of India have also released a sum of Rs.9.00 lakhs (Rupees Nine lakhs only) as first instalment for commencing the said work.

3. The Government of India have imposed the following conditions for implementing the schemes:-

 

(i)

The State Government would contribute the land for this project free of cost. The State Government will provide external water supply, Electricity approach road. Cost of furnishing, site development, compound wall fencing if any will also be the responsibility of the State Government.

(ii)

The State Government shall regularly furnish the quarterly statement of progress of work and expenditure incurred to the Central Department of Tourism. The Second instalment of 50% will be released on submission of bills, land possession certificate by the State Tourism Department and receipt of progress of work and the utilization certificate for the first instalment released. The Final instalment of 20% will be released on submission of Completion Certificate commissioning and utilization certificate.

(iii)

The State Government will execute the project through Kattida Maiyam, Vellore district and shall have the work started immediately to ensure timely Utilization of funds and to avoid escalation of cost. The project should be commissioned within a maximum period of 12 Months from the date of issue of sanction and any cost escalation on account of delay etc. should be met by the State Government on this account and no reimbursement will be made by the Central Government of this account.

(iv)

Funds will be utilized only for the purpose for which they are released. The State / Union Territory Government shall not rent / lease the property without the permission of Government of India.

(v)

The State Government would undertake the responsibility for maintenance of facilities for which funds are released and no reimbursement on account of losses incurred if any would be made by the Central Government.

(vi)

The State / Union Territory Government will not keep the amount released by Central Government unutilized for more than six months. In case of funds cannot be utilized by such time the same will have to be surrendered to Central Government. Formal approval should be taken to transfer / adjust the amount against the other Central financially assisted projects.

 

4. (i) The Commissioner of Tourism in his reference 4th cited has requested the Government to approve the project at total cost of Rs.40.00 lakhs with the Central share of Rs.30.00 lakhs and State share of Rs.10.00 lakhs and sanction a sum of Rs.9.00 lakhs being the first instalment of Central share released by the Government of India. He has also further stated that out of Rs.10.00 lakhs required as State share towards this project, an amount of Rs.5.00 lakhs has been allotted from M.P.s Local Area Development Scheme for the year 2002-2003 by the M.P.Tirupattur, Vellore District. The remaining amount of Rs.5.00 lakhs is to be met from the Jolarpet Panchayat Union funds and the Jolarpet Panchayat Union council has passed a Resolution (No.46, dated 22.5.2002) to allot Rs.5.00 lakhs from General Fund in this regard.

(ii) In respect of executing the work through Kattidamaiyam, the Collector of Vellore District has stated that, “the Kattidamaiyam is a society registered under Tamil Nadu Societies” Act and it is an agency created under the Chairmanship of the District Collector to execute works using Low Cost Technology, so that the construction cost of the building will be reduced.

(iii) The Commissioner of Tourism has recommended that the proposal of the District Collector, Vellore, entrusting this project work to the Kattida Maiyam. Vellore may be accepted as a special case and the District Collector may be requested to obtain the reasonability certificate from the Public Works Department after its completion.

5. The District Collector has recommended that the building, after completion may be placed under the control of Elagiri Tourism Promotion Society for future maintenance as the society is functioning under the Control of District Collector, Vellore District and the Society is looking after the Tourism Promotion activities in the Elagiri Hills Area. The District Collector has further stated that since the society has employed six workers to look after the maintenance aspects of park and other areas and the society has been created for the Tourism promotion activities in the Hill Area, it is more appropriate to entrust the work to the society instead of to the Elagiri Panchayat in view of its slender financial position. The Commissioner of Tourism has accepted the views of the District Collector and recommended it to the Government for early sanction.

6. However, after examination the Government have decided to entrust the work to the State Public Works Department instead of the Kattida Maiyam as the Kattida Maiyam did not fulfill the conditions laid down in the Tamil Nadu Tender Transparency Act 1998.

Further, the Government, after careful consideration approve the project of construction of Yatriniwas at Elagiri (Under the prioritized scheme of the Government of India for the year 1999-2000) at the total cost of Rs.40.00 lakhs and issue administrative sanction (Rupees Forty lakhs only) with the Central share of Rs.30.00 lakhs (Rupees Thirty lakhs only) and State share Rs5.00 lakhs from M.P.Local Area Development Fund and Rs.5.00 lakhs from Jolarpettai Panchayat Union funds, totally Rs.10.00 lakhs (Rupees Ten lakhs only) with the usual terms and conditions laid down by the Government of India, New Delhi in para 3 above and permit the District Collector Vellore to execute the project through State Public Works Department, Vellore instead of the Kattida Maiyam, Vellore.

8. Sanction is accorded for the payment of Rs.9.00 lakhs (Rupees Nine lakhs only) to the District Collector, Vellore District being the first instalment of Central share released by the Government of India vide the reference 2nd read above.

9. The expenditure is debitable under the following head of account:

“5452-Capital outlay on Tourism 01- Tourist infrastructure 101 Tourist Centre – Schemes in Tenth Five year Plan – VI Scheme shared between State and Centres – UC Providing basic amenities in Tourist Centre – 09.Grants in aid – 03. Grants for specific schemes” . (DPC:5452 01 101 UC 0934)

10. The Commissioner of Tourism, Chennai-2 is authorized to draw the amount sanctioned in para 8 above and disburse it to the District Collector, Vellore, Vellore District under proper acknowledgement.

The District Collector, Vellore District is requested to allocate the state share of Rs.10.00 lakhs (Rupees Ten lakhs only) i.e. Rs.5.00 lakhs from the M.P.s Local Area Development Scheme for the year 2002-2003 and the remaining amount of Rs.5.00 lakhs is to be met from the Jolarpettai Panchayat Union Fund vide resolution No.46 dated 22.5.2002.

12. The District Collector, Vellore District is also requested to place the Yatriniwas under the Control of Elagiri Tourism promotion society for its future maintenance, subject to the adherence of the terms and conditions issued by the Government of India in para 3 above by the District Collector, Vellore.

13. This order issues with the Concurrence of the Finance Department vide its U.O.No.190/SS/AKG/2004 dated 11.08.2004.
