ORDER:

A proposal  at an  estimated cost of Rs.16.00 lakhs (Rupees Sixteen lakhs only) for the Provision of Public Convenience near Varadharaja Perumal Temple, Kancheepuram with Central Assistance of  Rs.16.00 lakhs (Rupees Sixteen lakhs only) and State share of Rs.4.00 lakhs (Four lakhs only) was forwarded to Government of India, New Delhi vide the reference 1st read above.  The Ministry of Tourism, Government of India in the reference 2nd read above, have conveyed the sanction of the President of India for incurring an expenditure not exceeding  Rs.16.00 lakhs (Rupees Sixteen lakhs only) being the grant from Central Financial Assistance towards the project, for the Provision of Public Convenience near Varadharaja Perumal Temple, Kancheepuram an estimated cost  of Rs.20.00 lakhs.  The remaining sum of Rs.4.00  lakhs (Rupees Four lakhs only) shall be borne by the State Government.  The Government of India have also released Rs.3.60 lakhs (Rupees Three lakhs and Sixty thousand only) as 1st instalment as an advance for starting work.

2) The Government of India have imposed the following conditions:

(i) The State Government will provide external water supply, Electricity approach road and No objection Certificate from the respective Archaeological Department if the property belongs to them.

(ii) The State Government shall regularly furnish the quarterly statement of progress of work and expenditure incurred to the Central Department of Tourism.  The second instalment of 50% will be released on receipt of progress of work and the Utilization Certificate for the first instalment released.  The Final instalment of 20% will be released on submission of Completion Certificate and land transfer document transferring /leasing the title of the land in favour of Ministry of Tourism, Government of India.

(iii) The State Government will execute the project through Municipal Engineering Wing of Kancheepuram Municipality and shall have the work started immediately to ensure timely Utilization of funds and to avoid escalation of cost.  The project should be commissioned within a maximum period of 30 months from the date of issue of sanction and any cost escalation on account of delay etc. would be met by the State Government on this account.

(iv)  Funds will be utilised only for the purpose for which they are released.  The State/Union Territory Government shall not transfer rent/lease the property without the permission of Government of India.

(v)  The State Government would undertake the responsibility for maintenance of facilities for which funds are released and no reimbursement on account of losses incurred if any would be made by the Central Government.

(vi)  The State/Union Territory Government will not keep the amount released by Central Government unutilised for more than six months.  In case of funds cannot be utilised, such time the same will have to be surrendered to Central Government and their formal approval should be taken to transfer/adjust the amount against the other Central financially assisted projects.

3) The Commissioner of Tourism, in the reference 3rd read above, has requested the Government to sanction the sum of Rs.3.60 lakhs (Rupees Three lakhs and Sixty thousand only) released by Government of India as first instalment and to direct the Commissioner, Kancheepuram Municipality to meet the State share of Rs.4.00 lakhs (Rupees Four lakhs only) as per  the resolution of the Municipality Resolution No:270, dated:16-8-99 already ear-marked for this project and entrust the work to the Commissioner, Kancheepuram Municipality.  He has also requested to incorporate the terms and conditions stipulated by the Government of India in the sanction order.  He has also requested to incorporate the following conditions imposed by the Commissioner, Hindu Religious and Charitable Endowment Department, Chennai-34, vide his reference 4th read above.

(i) No construction work near Temple wall or opposite to temple door.

(ii) No fund should be sought for from Temple fund for implementing scheme.

(iii) If any legal dispute arises regarding the land, the Kancheepuram Municipality itself should solve.

4) The Government have carefully examined the proposal and have approved the above scheme at an estimated cost of Rs.20.00 lakhs (Rupees Twenty lakhs only) and accept the terms and conditions stipulated by the Government of India as well as condition imposed by the Commissioner, Hindu Religious and Charitable Endowment Department, Chennai-34 for implementing the scheme by the Commissioner of Tourism,Chennai-2, through the Kancheepuram Municipality.

5. Sanction is accorded for the payment of Rs.3.60 lakhs (Rupees Three lakhs and Sixty thousand only) to the Commissioner of Tourism, Chennai-2 being the first instalment of Central share released vide the reference 2nd read above.  The Commissioner Kancheepuram Municipality, Kancheepuram is directed to meet the State share of Rs.4.00 lakhs (Rupees Four lakhs only) for the above project as per the resolution No:270 dated 16-8-99 of the Kancheepuram Municipality.

6) The Commissioner of Tourism is authorised to draw the amount sanctioned in para 5 above and disburse the same to the Commissioner, Kancheepuram Municipality subject to the terms and conditions laid down in para 2 and 3 above.

7) The Commissioner of Tourism, Chennai-2 should direct the Tourist Officer, Mamallapuram to make periodical visit and monitor the progress of this project.

8) The amount sanctioned in para 5 above shall be debited to the new head of account to be opened under Demand No:50 as detailed below:-

“3452 Tourism -01 Tourist Infrastructure 101 – Tourist Centre VI Schemes shared between State and centre U.R. Government of India Assistance Scheme – 80 Lumpsum provision (DPC 3452 01 101 UR 8001)

9) The Commissioner of Tourism, Chennai-2 is the estimating reconciling and controlling authority for the above new head of account.

10) The pay and Accounts Officer, Chennai-9 Treasury Officer, Kancheepuram are requested to open the above new head of account in accounts.

11) The expenditure sanctioned in paragraph 5 above is on new service and the approval of Legislature will be obtained in due course.  Pending approval of the Legislature the expenditure will be met initially by an advance from the contingency fund.  Orders regarding which will be issued separately by the Government in Finance (BG I) Department.  The  Commissioner of Tourism is requested to apply to Finance (BG I) Department in the prescribed proforma for the sanction of an advance from the contingency fund together with a draft note for inclusion in the supplementary estimate for 2001-2002 along with a copy of this order.

12) This order issues with the concurrence of Finance Department vide its U.O. No: 4389/I & T/2002-1 dated 31-1-2002 and Additional Sanction Ledger No.675 (Six hundred and seventy five only).
