ABSTRACT Courts – Introduction of Evening Magisterial Courts in the Subordinate Judiciary – Orders – Issued. HOME (COURTS.II) DEPARTMENT G.O.
(Ms.) No.910 Read:- From the Registrar General, High Court, Chennai, D.O.Letter No.1711A / 2007 / C3, Dated: 11.4.2007 &&&&& ORDER: The Minister (Public Works and Law) while moving the Demand on Administration of Justice introduced on the Floor of the Assembly on 13.4.2007 that Evening Magistrate Courts will be introduced in Chennai, Madurai, Trichy, Coimbatore, Salem and Tirunelveli, Corporation Areas to try petty cases. 2. In pursuance of the above announcement, the Registrar General, High Court, Chennai has sent a comprehensive proposal to the Government for constitution of Evening Magistrate Courts in the Subordinate Judiciary. The Registrar General, High Court, Chennai has stated that on an experimental basis, Evening Courts can be introduced in every District Headquarters. Every Magistrate can be asked to preside over those Evening Courts daily two hours between 6.00 p.m. and 8.00 pm on rotation basis with supporting staff. Each Magistrate will be required to work atleast twice a week and 8 sittings during a month on rotation basis. 3. The Registrar General, High Court, Chennai has stated that the Magistrates manning these Evening Courts with the supporting staff can be extended the benefit of 25% of the Pay and D.A. by way of incentive for their services in the Evening Courts in addition to their regular work. 4. The Government examined the proposal of the Registrar General, High Court, Chennai in detail. Accordingly, the Government sanction the introduction of Evening Courts iin the Corporation areas to try petty cases accord sanction for Rs.67.20 lakhs (Rupees Sixty Seven lakhs and twenty thousand only) towards the payment of honorarium to the Judicial staff at the following rates. The Government also sanction the payment of flat rate of honorarium to the judicial staff at the following rates:- 1. Magistrate Rs.4000/- p.m. 2. Head Ministrial Officer Rs.3000/- p.m. 3. Bench Clerk/Typist Rs.2000/- p.m. 4. Office Assistant Rs.1000/- p.m. As per the list furnished by the Registrar General, High Court, the following judicial courts are functioning in the 6 Corporation areas including Chennai. Chennai 1 . No. of Metropolitan Magistrates in the cadre of Civil Judge(Senior Division) - 7 2. No. of Metropolitan Magistrates in the cadre of Civil Judge (Junior Division) - 17
5. The above sanction is for a period of one year from the date of setting up of the Courts. The Registrar General, High Court, Chennai is requested to ensure that performance of the Evening Courts is renewed at the end of one year and send necessary proposals for their continuation to Government if they are found to be effective. 6. The expenditure sanctioned in para 4 above shall be debited to the Head of Account:- "2014.00.Administration of Justice.105. Civil and Session Courts I Non.Plan AB – Mofussil, Civil and Sessions Courts – Regular Establishment – 01.Salaries.09 Honorarium (DPC 2014.00.105 AB.0195) 7. The expenditure sanctioned above shall be constituted an item of "New Service" for which approval of the Legislature will be obtained in due course. Pending approval of the Legislature, this expenditure will be met by drawal of an advance from the Contingency Fund. The Registrar General, High Court, Madras is authorized to draw and disburse the amount sanctioned. The Finance (B.G.I) Department will issue necessary orders separately. The Registrar General, High Court, Madras is requested to apply for Contingency Fund Advance in the prescribed format for the required amount to Finance (B.G.I) Department along with copies of the order. He is also requested to send necessary explanatory notes to include the above expenditure in the supplementary Estimate for 2007-2008 at the appropriate time without fail. 8.
