ABSTRACT Prisons Provision of Subsistence Allowance to those Prisoners who are produced at long distance Courts Amendment to rule 597 (3) and 842 of the Tamil Nadu Prison Rules, 1983 Orders Issued. HOME (PRISON.V) DEPARTMENT G.O.(Ms).No.1269 READ: From the Additional Director General of Prison RC No.24042/PW3/02, Dated:27.08.2002 and even number dated :10.06.2006. ***** ORDER: As per rule 842 of the Tamil Nadu Prison Rules,1983, when an under trial prisoners detained in a prison has to be sent to court, he shall be given his food before he goes and arrangements made to enable him to have his food when he returns. The Additional Director General of Prisons, Chennai has stated that in accordance with this rule, the remand/under trial prisoners are given food (lunch) before they leave the prison and arrangements are made to enable them to have their food when they return. Now, the High Court, Madras in its order dated 12.04.2002 in Writ Petition No.12396/02 filed by Esakkimuthu, has directed the Government to regulate the system of serving food to the under trial prisoners and the prisoners who are produced at the long distance courts. 2. While providing food as per rules, in some cases, the food pockets provided to the prisoners become stale due to long journey by the prisoners to attend the Court. To overcome this problem and in the light of the directions of the High Court, Chennai, the serving of food to the prisoners need to be regulated and the Additional Director General of Prisons has sent proposal to Government to issue suitable amendments to the Tamil Nadu Prison Rules, 1983. 3. In the light of the directions of the High Court, Madras, the Government have decided to amend the relevant rules so as to enable the prison authorities to provide food and subsistence allowance to the remand and under trial prisoners when they are taken out of prisons for production before the court. 4. The following Notification will be published in the Tamil Nadu Government Gazette:- NOTIFICATION In exercise of the powers conferred by section 59 of the Prisons Act, 1894 (Central Act IX of 1894), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Prison Rules,1983. AMENDMENTS In the said Rules:- (1) In rule 597, for sub-rule (3), the following sub-rule shall be substituted, namely:- "(3) Subsistence Allowance shall be paid to the prisoners at the following rates, namely:- A Class and Special class remand and under trial prisoners be paid at Rs.20/- per prisoner per meal. B Class and ordinary remand and under trial prisoners be paid at Rs.15/- per prisoner per meal"; and (2) for rule 842, the following rule shall be substituted, namely:- 842. Food arrangement during trial:- (1) Every prisoner who has to be sent to court, shall be given packed food for lunch and if he returns late after 10.p.m.or returns next morning, as the case may be, then he shall be fed by a subsistence allowance by the escort party at the following rate:- A Class and Special class remand and under trial prisoner Rs.20/- B class and ordinary remand and under trial prisoner Rs.15/- (2) The following shall be the feeding time of the prisoners who is attending court of transit:- (1) Breakfast between 6.00 a.m. and 8.00 a.m. (2) Lunch between 1.00 p.m. and 2.00 p.m. (3) Dinner between 8.00 p.m. and 10.00 p.m. (BY ORDER OF THE GOVERNOR) S.MALATHI, To The Additional Director General of Prisons, Chennai-8 All Deputy Inspector General of Prisons, Central Prisons The Works Manager, Government Central Press, Chennai-79 All Prison Sections Superintendent of all Central Prisons. //FORWARDED/BY ORDER// SECTION OFFICER |
