Home, Prohibition & Excise (Transport-V) Department G.O.Ms.No.1213 READ 1) G.O.Ms.No.292, Home (Tr-V)Dept, dated ; 22.2.2007. 2) From the Transport Commissioners, Chennai letter No.4498/C3/2007, dated 4.6.2007. 3) G.O.Ms.No.797,Home (Tr.V) Dept. dated 4.6.2007. 4) From the Transport Commissioner, Chennai letter No.4498/C3/2007, dated 26.06.2007. ---------- ORDER: In the Government order third read above, draft amendment to the Tamil Nadu Motor Vehicles Rules, 1989 exempting the compulsory wearing of helmet in respect of the persons who belong to “Meivazhi Sabha” or “ Meivazhi Salai “ who wear turban while they ride on a motor cycle and ‘Woman” or ‘Child’ travelling in a motor cycles as pillion rider has been published in the Tamil Nadu Government Gazette inviting suggestion and objection from the public. The same has been published in Home Department Notification No. SRO A- 19 (g)/2007 at pages 1-2 of part III – Section 1 (a) of the Tamil Nadu Government Gazette Extraordinary, dated the 4th June - 2007. 2. Certain objections and suggestions have been received from the public in the matters. Objections and suggestions have been examined in consultation with the Transport Commissioner, Chennai. The Government have decided to overrule the objections and to confirm the said draft amendment issued in the said Notification with G.O.Ms.No.797, Home (Tpt – VI) department, dated 4.6.2007. 3.Accordingly the following Notification will be published in the Tamil Nadu Government Gazette Extraordinary dated the 13.8.2007. NOTIFICATION In exercise of the powers conferred by the second provision to section 129 of the Motor Vehicles Act,1988 (Central Act 59 of 1988), the Governor of Tamil Nadu hereby makes the following amendment to the Tamil Nadu Motor Vehicles Rules, 1989, as the same having been previously published, as required by sub – section (1) of section 212 of the said Act. AMENDMENT In the said rules , after rule 417, the following rule shall be inserted namely:- “417 – A . Exceptions in wearing Protective headgear (Helmet):- The provisions of section 129 of the Act providing for compulsory wearing of Protective headgear (helmet) shall not apply to the following categories, namely:- (i) Persons who belong to “ Meivazhi Sabha “ or “Meivazhi Salai” who wear turban while riding on a motor cycle: and (ii) “Woman” or “Child” riding in motor cycle as pillion rider. Explanation: For the purpose of this rule, “Woman” means a female human being of any age and “Child” means a male human being under twelve years of age. By Order of the Governor (S.
