No. 1726/ 2002/ G4, dt: 9.7.2003. ***** ORDER: The Registrar General, High Court, Madras has sent a proposal to the Government for the constitution of 4 Mahila Courts one each at Madurai, Tiruchirapalli, Tirunelveli and Salem for speedy trial and disposal of cases of offences committed against women and also cases under the other Social Laws enacted by the Central and State Governments for the Protection of Women headed by District and Sessions Judges as requested by the Government. It is considered that Mahila Courts, exclusively to deal with offences against women is a must to cope with the cases arising on account of the enactment of many social Laws for the Protection of Women and also to deal particularly with cases of bride burning, rape, outraging the modesty of women and kidnapping. 2. The Government have examined the proposal of the Registrar General, High Court, Madras and they sanction the constitution of 4 Mahila Courts one each at Madurai, Tiruchirapalli, Tirunelveli and Salem (Headed by District and Sessions Judges) for speedy trial and disposal of cases of offences committed against women and also cases under other social Laws enacted by the Central and State Governments for the Protection of Women. 3) For the proposed Courts, the Government have decided to sanction staff and furniture on the pattern of Fast Track Courts. They accordingly, sanction the creation of temporary staff mentioned in the Annexure to this order for a period of one year from the date of employment or till the need therefor ceases, whichever is earlier for the 4 Mahila Courts sanctioned in paragraph 2 above. 4) The holders of the temporary post mentioned in the Annexure will be eligible to draw besides Pay, Dearness Allowance, and other allowances at the rates admissible to them under the orders and rules in force from time to time. 5) The Government also sanction an expenditure not exceeding Rs. 4,69,400/- (Rupees Four lakhs sixty nine thousand and four hundred only) towards purchase of articles of furniture for the four Mahila Courts. 6) The Government also sanction the provision of a telephone one each at the 4 Courts and four at the residences of Judges of the 4 Courts sanctioned in para 2 above. The Government also sanction a sum of Rs.40,000/-(Rupees Forty thousand only) at the rate of Rs.1,000/- per court towards permanent Advance. The Government also sanction the incurring of an expenditure not exceeding Rs. 15,00,000/-(Rupees Fifteen lakhs only) towards purchase of 4 cars for the use of 4 Presiding Officers of the 4 Courts. Sanction is also accorded for a sum of Rs. 55,000/0 (Rupees fifty five thousand only) towards fuel and maintenance charges for the cars. Sanction is also accorded to incur an expenditure not exceeding Rs. 20,000/-(Rupees twenty thousand only) towards purchase of library books for the 4 Courts. 7) Sanction is also accorded for the supply of 4 typewriters with Tamil Key Board and 4 typewriters with English key board at the rate of one Tamil and one English Typewriter for each of the Court as issued in G.O.Ms.No.113, Transport, dt: 30.1.89. The Registrar General, High Court is requested to address the Director of Stationery and Printing with a copy of this Government Order for the supply of typewriters. The typewriters when supplied by the Director of Stationery and Printing, Chennai, shall be placed in charge of qualified persons who should be held responsible for their proper maintenance, care and upkeep of the typewriters and the typewriters should be returned to the Director of Stationery and Printing when such persons cease to be available or if for any reasons they are no longer required. The Director of Stationery and printing is also requested to supply forms, registers, stationery articles etc., free of cost to the Courts sanctioned in paragraph 2 above. 8) The expenditure sanctioned in paragraphs 3 to 6 above shall be debited to "2014.00. Motor Vehicles 01 purchase (DPC No. 2014 00 105 AA 2113) 02 Maintenance of functional vehicles (DPC No. 2014 00 105 AA 2122) 45 Petroleum oil & Lubricants (DPC No. 2014 00 105 AA 4504) 9) The expenditure sanctioned in paragraphs 3 to 6 above shall constitute an item of "New Service" and the approval of Legislature will be obtained in due course. Pending approval of the Legislature, the expenditure will be initially met by an advance from the Contingency Fund, orders regarding which will be issued from Finance (BG.I) Department, separately on receipt of necessary application as in the prescribed format from the Registrar General, High Court, Chennai together with a copy of this order for sanction of an advance from the Contingency Fund. The Registrar General, High Court is also requested to send a draft explanatory not indicating the total cost of the scheme in the Financial year in which it is implemented, the quantum of advance from contingency Fund Advance required to meet the expenditure initially with a pre-description of the scheme for inclusion of expenditure in the supplementary estimate for being brought to the notice of the Legislative Assembly. 10) This order issues with the concurrence of the Finance Department vide its U.O.119/DS (BN)/03, dated 4.8.2003 and additional sanction Ledger No. 333.
