ORDER

The road and other works in Highways Department were executed Prior to 7-5-2003 by calling for tenders for individual work. In G.O. first read above the Government have ordered that tenders be invited in packages in respect of all works in a division excepting CRF and NH works. Subsequently, in G.O. second read above the division wise packaging was modified into sub-division wise packaging with further exemption that for capital works costing  Rs.5.00 crores and above and for works taken up during natural calamities for which tenders could be invited for individual works.

2. The Chief Engineer (General) reviewed the functioning of the system and pointed out the following difficulties:-

  1. i)   Several representations were received from the contractors registered in the lower classes that they are unable to participate in the tenders under package system, since Class-I contractors only became eligible to compete in the tenders under Package System for Sub-Division.
  2. ii)   In view of grouping of works, the total value of works is high and no appreciable competition was possible among the contractors, since limited contractors only could compete for the tender, even though wide publicity was given.
  3. iii)  Since the value of contract was high in Sub-Division wise package system, the settlement of tenders at various levels took a long time process and revalidation for the lapse of the validity period have to be obtained from the tenderers.  Some times, the tenderer did not come forward to furnish the revalidation for the tenders and it led to re-tender.  During re-calls the responses were far from satisfactory and led to time over run  and consequent cost over run also.
  4. iv)  During execution of works, the Engineers of this Department faced great difficulties while supervising the  works as one contractor only execute the work throughout the Sub-division and his representatives were not available in most of the work spots and supervision became ineffective.
  5. v)  The successful contractor get work awarded under package containing all the works in a Sub-Division for himself and sets his own priority for the execution of work i.e., starts the work in easy and convenient areas first leaving behind the difficult works which may be very important and urgent in nature from the point of view if possible.  Thus, the works were delayed and completed far beyond the agreement period and the benefits did not reach the public in time.
  6. vi)  There is a tendency on the part of the successful tenderer, awarded two or more packages at a time, to sub contract the work which made monitoring difficult.
  7. vii)   In any Sub- Division apart from original works sanctioned by the Government, works like periodical renewal, Ordinary and Special Repairs sanctioned under the Non-Plan, restoration of road cuts done by the utility departments like Telephones, Electricity Board, TWAD etc., works connected with VVIP visits are also undertaken. Besides urgent repairs, works of permanent nature also have to be undertaken to the road stretches damaged due to natural calamities.  There is no appreciable competition among the contractors in view of the high value of work due to clubbing of works, since Class-I contractors alone could compete for the tender.

The Board of Engineers have therefore recommended that the sub division wise package system for calling tender may be discontinued. The Chief Engineer (General), Highways has requested the orders of the Government in the matter.

6. The Government have, carefully, examined the recommendations of the Board of Engineers and decided that   the sub – divisional package system of tenders in Highways Department be discontinued with immediate effects and tenders be called for individual work wise as was, in vogue prior to 7-5-2003. Accordingly, the following amendments are issued to Tamil Nadu Highways Manual Volume IV.

AMENDMENT

  For the existing para 157 of Tamil Nadu Highways Manual Volume  IV  and the proviso made  there under the following shall be substituted namely:-

  “157. Tender documents must be prepared for each work separately  and noted in a register. The name of works, the names of persons to whom the forms are sold and date should be entered in the forms making necessary entries in the register. Such forms sold only by the Department should be deemed valid for a particulars work.”

7. This orders issues with the concurrence of Finance Department vide its U.O.No. 2359/FS/P/2006, dated 29.6.2006.

ORDER:

 Under CRIDP for 2005-2006 improvement to road net work at a cost of Rs.820 crores covering a total road length of around  6700  Kms was sanctioned in the G.O. first read above.

2. The Chief Engineer (Gl) has   stated that it is essential to continue the efforts to improve the road network in the State and make it one of the best in the country with well-built infrastructure.  Hon’ble Minister for Highways has announced on the floor of the Legislative Assembly that all the single lane State Highways will be widened to two lane in a phased manner.  Accordingly, in the letter second read above the Chief Engineer (General) has submitted proposals for widening strengthening and improvement of the roads under three categories namely, State Highways, Major District Roads and Other District Roads under Comprehensive Road Infrastructure Development Programme   (CRIDP) 2006-07 at an estimated cost of Rs.722.400 crores against the Budget provision available for the year as detailed below:-

  1. 3. The Government have examined the proposal of the Chief Engineer (General) Highways and have decided to approve the proposal.  Accordingly the Government accord administrative sanction for improvement of State Highways, Major District Roads and Other District Roads at a total cost of Rs.722.40 crores (Rupees seven hundred and twenty two crores and forty lakhs only) under the Comprehensive Road Infrastructure Development Programme for the year 2006-07 as per outlay indicated in para 2 above. The details of the works are annexed to this order.

  4. The expenditure sanctioned in para 3 above shall be debited to the following heads of account:

(i) State Highways:-
