****** ORDER:
In the reference first read above, the Manager, Infrastructure Leasing and Financial Services Limited has sought for sanction for a sum of Rs.20 Lakhs as commitment fee for the development of Road Projects as the same has been provided for in the Memorandum of Agreement between, Government of Tamil Nadu and Infrastructure Leasing and Financial Services Limited. The Ministry of Finance, Government of India, also informed that the World Bank has granted No Objection for sanctioning the Commitment fee. Accordingly , the Government in the reference second read above, has permitted the project Director, Tamil Nadu Road Sector Project to draw and disburse in the manner specified therein kRs.10 lakhs as commitment fee which is 10% of the amount payable to Infrastructure Leasing and Financial Services Limited as provided for under Clause 13 of the agreement entered in to by Government of Tamil Nadu with Infrastructure Leasing and Financial Services Limited.
2. In the reference third read above, the Project Director, Tamil Nadu Road Sector Project was requested to inform the Infrastructure Leasing and Financial Services Limited to send at least one BOT format to ensure the goals of Memorandum of Understanding and to release the balance commitment fee of Rs. 10 lakhs.
3. The Project Director, Tamil Nadu road Sector project, in his letter fourth read above has requested orders on Draft Model Concession Agreement to be entered with Infrastructure Leasing and Financial Services Limited and for releasing the balance 50% commitment fee of Rs.10 lakhs payable to Infrastructure Leasing and Financial Services Limited.
4. The Government after careful consideration of the request of the project Director, Tamil Nadu Road Sector project, sanction and permit the project Director, Tamil Nadu Road Sector project to draw the balance of 50% of commitment fee of Rs.10 lakhs (Rupees Ten lakhs only)out of Rs.20 lakhs as per agreement and disburse the same to Infrastructure Leasing and Financial Services Limited. The Project Director, Tamil Nadu Road Sector project is also requested to accommodate the above expenditure within the budget provision available in Revised Estimate 2001-2002.
5. The Project Director , Tamil Nadu Road Sector project is directed to intimate the amount disbursed to Infrastructure Leasing and Financial Limited as para 4 above.
6. The expenditure is debited under the following Head of Account:
" 5054 - Capital outlay on Roads and Bridges - 80General - 800 - Other Expenditure- II State plan - PB Tamil Nadu State Highways Project 16 Major works - D-P-code No.5054-80-800-PB-1604)."
7. This order issues with the concurrence of the Finance Department vide its U.O.No.3800 / PW I / 2002-1, dated 28-1-2002.
