Implementation of e-tendering in a phased manner – Amendment to Tamil Nadu Transparency in Tenders Rules, 2000 – Orders – Issued.

ORDER: -

In the Budget Speech for 2007-2008 delivered in the Legislative Assembly on 23.03.2007, it has been announced that e-tendering will be implemented in two phases and in its first phase, starting from 1.7.2007, tender forms for open tenders for a value exceeding Rs.10.00 lakhs can also be obtained through the internet and in the second phase, starting from 01.10.2007, bids can also be submitted on-line through the web sites of the concerned departments.

2. Based on the above announcement made in the Budget Speech 2007-2008, Government now issue the following orders for implementation of e-tendering in a phased manner: -

(a) The first phase of the e-tendering viz., electronic supply of tender documents will be introduced in respect of open tenders for procurement exceeding a value of Rs.10 lakhs. It will be commenced from 01.07.2007.

(b) The accessibility of tender documents on Government website will be in addition to the other forms of supply of tender documents.

(c) National Informatics Centre will be the Nodal agency for the activities connected with this.

To operationalise the above decision, the Government have decided to amend the provisions of rule 15 (2) and rule 16 (2) and (3) of the Tamil Nadu Transparency in Tenders Rules, 2000.

3. Accordingly, the following Notification will be published in the Tamil Nadu Government Gazette Extraordinary dated the 22nd May 2007.

NOTIFICATION

In exercise of the powers conferred by sub-section (1) of section 22 of the Tamil Nadu Transparency in Tenders Act, 1998 (Tamil Nadu Act 43 of 1998), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Transparency in Tenders Rules, 2000: -

AMENDMENTS

In the said Rules,-

(1) in rule 15, for sub-rule (2), the following sub-rule shall be substituted, namely:-

" (2) The qualification criteria in terms of registration of contractors in the cases where the procuring entity has a system of registration of contractors, the required experience, available manufacturing and construction capacity, technical and other manpower and financial status shall be clearly stated in the tender documents.";

(2) in rule 16,-

(a) for sub-rule (2), the following sub-rule shall be substituted, namely:-

"(2) The Tender Inviting Authority shall ensure that the tender documents are made available to any person who is willing to remit the cost of such documents.";

(b) for sub-rule (3), the following sub-rule shall be substituted, namely:-

"(3) (a) The tender documents shall be made available at –

(i) the office of the Tender Inviting Authority;

(ii) any other office or place indicated by the procuring entity.

(b) In respect of procurement where the estimate value of procurement is Rupees Ten Lakhs and above, the tender document shall be made available for downloading free of cost at the web site designated for this purpose by the Government. Tender documents may also be made available free of cost at such other web sites as may be indicated by the Tender Inviting Authority."
