ORDER:

In paragraph 6 of the Government Order first read above, the following orders were issued:-

"The Government direct that the arrears due to the Pensioners/Family pensioners be calculated for the period from 1.1.1996 to 31.3.1998 after adjusting the third instalment of interim relief paid with effect from 1st April 1996. Out of this amount, the adhoc arrear payment of Rs.1000/- already received by the Pensioners/Family pensioners should be deducted. From out of the net arrear amount so arrived at, 20% shall be paid in 1998-99, and 20% be paid during the next financial year. The balance 60% of arrears shall be paid to the Pensioners/Family pensioners after five years i.e. in the year 2003-2004 with interest as admissible to General Provident Fund."

2. The arrears amount with interest have accumulated to nearly Rs.1800 crores in the year 2003-2004. It was impossible to pay arrears in one lumpsum in view of difficult financial position of the State. In order to balance the financial position of the State and taking into account of all the relevant factors, the Government have announced the revised scheme in regard to payment of arrears of Commutation and Gratuity to the pensioners who were retired between 1.1.1996 to 31.3.1998 as follows:

  • Arrears on account of Commutation in respect of employees, who retired between 1.1.1996 to 31.3.1998, will be paid in three equal annual instalments with interest as applicable to General Provident Fund starting from the financial year 2004-2005.

  •  Arrears of Gratuity amount in respect of employees who retired between 1.1.96 and 31.3.98 together with interest as applicable to General Provident Fund will be paid to the pensioners in three equal annual instalments in cash with interest starting from the financial year 2004-2005.

Accordingly, orders have been issued in the Government Orders second and third read above.

3. In the circumstances, the following amendment shall be issued to para 6 of the Government Order first read above.

AMENDMENT

In the said Government Order, for para 6, the following para shall be substituted, namely:-

6. "In the Government Order fourth read above, the Pensioners and Family Pensioners were granted an adhoc arrear payment of Rs.1,000/- pending revision of Pension/Family pension. The Government direct that the arrears due to the Pensioners/Family pensioners be calculated for the period from 1.1.1996 to 31.3.1998, after adjusting the third instalment of interim relief paid with effect from the 1st April 1996. Out of this amount, the adhoc arrear payment of Rs.1,000/- already received by the Pensioners/Family pensioners should be deducted. From out of the net arrears amount so arrived at, 20% shall be paid in 1998-99 and 40% be paid during 1999-2000 and 40% be paid during 2000-2001.

In respect of arrears of Commutation and Gratuity, 20% shall be paid in 1998-99 and 20% be paid in 1999-2000. The balance 60% of arrears of Commutation and Gratuity shall be paid to the pensioners, who retired between 1.1.1996 and 31.3.1998, with interest as admissible to General Provident Fund in three equal annual instalments, starting from the financial year 2004-2005".
