ORDER:

In the letter first read above Government of India have issued amendment to Environmental Impact Assessment Notification 1994.  The amended Notification will apply to all the projects which are received after 10th April 1997.  In order to have proper assessment of the General Public, the Government of India interalia amended the E.I.A. Notification dated 10.4.97 for giving effect to Public hearing as mandatory for all the projects covered in schedule-I of the E.I.A. Notification with effect from 10.4.97.  In the amended Notification the Government of India has detailed the composition of the Public Hearing Panel in the districts, process of public hearing, Notice of public hearing and access to the executive summary.

2. In the G.O. second and third read above, the Government accordingly constituted the Committee for Public hearing Panel in 29 districts with the composition of members as stipulated therein.

3. Now the Tamilnadu Pollution Control Board has sent revised panel of Public Hearing in respect of Nilgiris, Madurai, Cuddalore and Namakkal and requested to reconstitute the Public Hearing Panel, with the representation from Local bodies and Senior Citizens.

4. The Government after careful examination of the proposal of the Tamilnadu Pollution Control Board and the panel of names submitted by the 4 district Collectors Nilgiris, Madurai, Cuddalore and Namakkal decided to reconstitute the Public hearing panel with revised representation from Local bodies and senior citizens in the 4 districts.  The Government accordingly reconstitute the committee for Public Hearing Panel with the composition of members as detailed in the Annexure to this order, in supersession of the orders issued in the G.Os. second and third cited in respect of the above four districts.

5. The Government direct the Tamilnadu Pollution Control Board to conduct the Public Hearing as per the provisions envisaged in the E.I.A. Notification 1994 as amended on 10.4.97.

6. The Government also direct that the expenditure to be incurred for conducting the Public Hearing will be collected from the proponent concerned.

7. The panel for the remaining 20 districts will be issued separately.
