GOVERNMENT OF TAMIL NADU ABSTRACT FORESTS-Wildlife-Ex-gratia /Compensation to the loss of human life and damages caused by Wildlife-Creation of Revolving Fund with Rs.8.00 lakhs and Constitution of a Committee with delegation of powers to operate the Fund-Orders-Issued. ENVIRONMENT AND FORESTS(FR.5)DEPARTMENT G.O.(Ms)No.171 READ: 1. G.O.(Ms)No.205, Environment and Forests, dated 12.9.2000. 2. From the Principal Chief Conservator of Forest's Letter No.WL3 / 70792 / 2002, dated 12.12.2002, 14.1.2003 and dated 16.6.2003. ---- ORDER: The Principal Chief Conservator of Forests has stated that for any loss of human life, injuries and other damages caused by Elephants, Tigers, Panthers etc. the ex-gratia / compensation are being paid from the funds sanctioned by the Government of India under the Project Elephant and Project Tiger schemes as per the guidelines issued in the G.O. first read above. Based on the sanction of the Government of India, the State Government issued orders. The compensation of ex-gratia is sanctioned for the loss of human life by the Chief Wildlife Warden and for the injuries or damages caused by the elephants are sanctioned by the Conservator of Forests concerned and a copy of the sanction order is sent to the Conservator of Forests, Coimbatore Circle who is maintaining the priority list and the payment is made by the Conservator of Forest, Coimbatore through the concerned District Forest Officers/Conservators of Forests as soon as funds are received from Government of India. This system has got some practical difficulties due to which the claims could not be settled as and when the incidents take place. As a result, the aggrieved family members have to wait for a long time to get their claim settled. 2.The Hon'ble Chief Minister, while reviewing the performance with the District Collectors on 11.12.2002, has expressed concern for such delay and instructed to settle the claims immediately as and when proposals are received from the members of the affected families. in the light of the Hon'ble Chief Minister's instructions and to avoid any such delay in future, the Principal Chief Conservator of Forests has proposed to constitute a 'Revolving Fund' with the funds of State Government to the tune of Rs.40.00 lakhs. This facility will help the department to disburse the ex-gratia compensation immediately. The fund released from the 'Revolving Fund' can be recouped as and when the funds are received from the Government of India under Project Elephant and Project Tiger Scheme. 3.The Principal Chief Conservator of Forests has also requested the Government to constitute a Committee consisting of Secretary to Government, Environment and Forests department, Principal Chief Conservator of Forests and Chief Wildlife Warden for this purpose. He has subsequently requested the Government to constitute the 'Revolving Fund' with Rs.25.00 lakhs and to authorize the Conservator of Forests, Coimbatore to operate the Revolving Fund by opening a Savings Bank Account. 4. The Government have examined the proposal of the Principal Chief Conservator of Forests carefully and accord sanction for the creation of 'Revolving Fund' with funds of State Government to the tune of Rs.8.00 lakhs for giving ex-gratia/compensation to the loss of human life and damages caused by wildlife as per the norms /guidelines prescribed/issued in the Government Order first read above. Government also constitute a Committee with the following members to operate the 'Revolving Fund' and to recoupe the same as and when the funds are received from the Government of India under the Project Elephant and Project Tiger Schemes:- (1)

The Chief Wildlife Warden, 5. The Committee shall meet as frequently as considered necessary but at least once in a year. 6. The Member Secretary of the Committee will convene the meeting. 7. The amount sanctioned in para-4 above will be met under the following head of account to be opened under demand No.14, Environment and Forests Department:- "2406.Forestry and Wildlife-01.Forestry.800-Other Expenditure. I Non- Plan AW. Contribution to Revolving Fund for payment of compensation to the loss of human life and damages caused by wildlife. 10- Contribution. Contribution to Specific Fund. (D P C 2406-01-800 AW 1013)". 8.The sanctioned amount shall be transferred through the following head of account:- "2406.Forestry and Wildlife-01. Forestry-797. Transfer to Reserve Funds/Deposits Accounts-I Non-Plan A.D. Transfer to the Revolving Fund for payment of compensation to the loss of human life and damages caused by Wildlife-30. Inter account transfer' (D P C 2406 01 797 AD 3009) by contra crediting into, "8229.00.Development and Welfare Funds-200 Other Development and Welfare Fund-AS Revolving Fund for payment of compensation to the loss of human life and damages caused by the wildlife". (D P C 8229 00 200 AS 000B) (Receipts). 9.The Principal Chief Conservator of Forests shall draw the amount to be sanctioned as and when necessary by debiting under his regular service head of account and then he shall make necessary adjustment entry by transferring the sanctioned amount from the Revolving Fund account to the consolidated fund account under the following head of account:- "2406.Forestry and Wildlife-01. Forestry-902.Deduct-Amount met from the Revolving Fund for payment of compensation to the human life and damage caused by wildlife-I Non-Plan-AB. Deduct-Amount met from the Revolving Fund for payment of compensation to the human life and damage caused by the wildlife-30. Inter account transfer ". (D P C 2406 01 902 AB 3008) by contra credit debiting from:- "8229-00-Development and Welfare Fund-200.Other development and Welfare Fund - AS. Revolving Fund for payment of compensation to the loss of human life and damages caused by wildlife". (D P C 8229 00 200 AS 0009) (Outgo). 10.The Principal Chief Conservator of Forests is requested to furnish the particulars of the amount to be credited in the Revolving Fund and the statement of expenditure to be met from the Revolving Fund at the closure of each financial year to the Accountant General (A & E), Chennai-600 018. 11.Necessary provision of funds will be made in the Revised Estimate/Final Modified Appropriation 2003-2004.
