ORDER:

            The Inspector General of Registration proposed certain proposal  to equip the  Registration  Department to cater to the needs of the registrant public.  While examining this proposal, the Government have decided to augment the revenue resources to meet out the increasing expenditure on day-to-day administration of the Department by way of enhancing the copying fee leviable under Article 14 of the Table of Fees prepared under Section 78 of the Registration Act, 1908.  Accordingly the Government have decided to revise the fee from the existing rate of Re.1.00 to Rs.1.50 in respect of other cases for every 100 words or part thereof.   The notification appended to this order provides to the above amendment to Article 14 of the Table of Fees. 

2.  In view of the discrepancies due to inconsistant  amendments with each other issued in the  Government Orders  second and third  read above, the Government have   decided to revise the  existing Article 14  entirely.   The notification appended  to this order  provides amendment to Article 14 of the Table of   Fees accordingly.

3.  The notification appended to this order will be published in the Tamil Nadu Government Gazette.

            4.  The  Works Manager, Government Central Press, Chennai is  requested to send five copies of the notification as published in the Gazette.

APPENDIX

NOTIFICATION

            In exercise of the powers conferred by section 78 of the Registration  Act, 1908 (Central Act XVI of 1908), the Governor of Tamil Nadu hereby makes the following amendment to the Table of Fees published with erstwhile Judicial Department Notification No.177 dated the 30th March 1909, at pages 316 to 319 of Part I of the Fort St. George Gazette, dated the 30th March 1909, as subsequently amended:-

AMENDMENT

            In the said Table of Fees, for  Article 14, the following Article shall be substituted, namely :-

“ 14. Making or granting copies of registration entries or documents, for the benefit of any person,-

(1)   (a)           when such copies are made by copying machine,-

(i) for a copy of a page             Rs.2/- (Rupees two only) per page subject  to a

    containing words        minimum of Rs.5/-(Rupees five only).

    not exceeding 300.

(ii) for a copy of a page             40 paise per page subject to

     containing words not     a minimum of Rs.5/-( Rupees five only )

     exceeding 5

(b)   In other cases for every            Rs.1.50 ( Rupees one and paise fifty only)

       100 words or part

       thereof.

Explanation ,-   In reckoning the number of words, every figure, initial or

   abbreviation shall  count as a word.

 (c)   For granting of a copy of the map forming              Rs.3.00

        part of a registered document without the            ( Rupees three only)

         help of a Draughtsman  or Surveyor

         by the registering officers.

(d)       for granting a copy of the map forming         

part of a registered document with the

help of a private Draughtsman or

Surveyor,-

            (i)  If the measurement of the map               Rs. 5.00( Rupees five only)

                 does not exceed 60 cm.x 50 cm.

            (ii) If the measurement of the map               Rs. 10.00( Rupees ten only)

                 exceed 60cm x 50 cm

          (iii) for certifying the copy of the map              Rs.2.00( Rupees two only)

                 prepared either by the registering

                 officer or by  a private

                 Draughtsman or Surveyor.              

            (2)   In the case of copies of maps or plans, a reasonable fee to be specially fixed by the registering officer:

                   Provided  that in calculating the charge to be made for copies of entries of documents at the rates prescribed, it shall not be necessary unless, the applicant challenges the accuracy of the charge made, actually to count the number of words in such entries or documents but the charge may be made on a reasonable estimate drawn  by the registering officer, of the number of words which the entries or documents are considered to contain.

(3). Government Officers who may require to search the register or to take copies of entries for bonafide public purpose shall be permitted to do so without payment of any fee.

            In the Kanyakumari District and  Shencottah Taluk of Tirunelveli District,  Sreepadam Officers who may also require to search the registers or to take copies for bonafide   Sreepadam purposes shall be permitted to do so without payment of any fee.

(4). Where an applicant presents a printed or typed copy of a document already registered and applies for a certified copy of the same, only the portion added in manuscript in the  certified copy shall be charged for, at the  rates for copying and,  in addition, a fixed fee of 50 paise shall be levied for  comparing and certifying each copy:

Provided that no such copying fees shall be charged in respect of an application made by the investigating officers of the Directorate of Vigilance and Anti Corruption, Kerala.”
