Cooperation, Food and Consumer Protection(CN1) Department G.O.(Ms)No.46 Read: 1) Judgements in Writ Appeal Nos.2501 and 2502/01 dated 24.10.2002, W.P.Nos.16190 etc. dated 9.12.2002, w.P.Nos.41932 etc. Batch, dated 8.1.2003 and W.P.Nos.128,3209 to 3218/03 etc., Batch dated 8.8.2003 of the Hon’ble High court of Judicature, Madras. 2) G.O.(Ms)No.373,Cooperation, Food and Consumer Protection Department dated 29.10.2002. 3) Letter Rc.No.21026/2003 SF3(SBC) dated 7.3.2003 of the Registrar of Co-operative Societies, Chennai. 4) Government Letter No.16436/CN1/2003-3,Cooperation, Food and Consumer Protection Department dated 7.10.2003. ----- ORDER: In compliance with the orders in the reference first and second read above the Registrar of Co-operative Societies submitted the proposal relating to the Special bylaw of AA206 Periyakodivery Primary Agricultural Cooperative Bank Limited in his letter third read above for approval of the Government . 2. The Government, after careful examination and taking into account the nature of business, volume of transactions and financial position of AA.206 Periyakodivery Primary Agricultural Cooperative Bank approve with certain modifications the appended special bylaws covering the service conditions of employees of the Primary Agricultural Cooperative Bank Ltd., functioning in Erode District under sub-rule (1) of rule 149 of the Tamil Nadu Co-operative Societies Rules 1988. 3. The Government, in exercise of the powers vested with them under Section 179 of the Tamil Nadu Co-operative Societies Act,1983 exempt the AA 206 Periyakodivery Primary Agricultural Cooperative Bank from the provisions of Section 11 of the said Act and Rule 9 of the Tamil Nadu Co-operative Societies Rules 1988 in so far as they relate to the adoption of the Special bylaws covering the service conditions of employees and direct that the Special bylaws as approved by the Government shall be valid and take effect from the date of approval. 4. The AA 206 Periyakodivery Primary Agricultural Cooperative Bank may at any time with the prior approval of the Government, include any new provision of delete of modify any of the provisions contained in this approval Special bylaws so as to suit its special needs or local conditions.
