From the Registrar of Cooperative Societies Lr.No.30678/2003 IP2 Dated21.5.03 ----- ORDER: In the G.O first read above, the Government have constituted a Single Purchase Committee under the Chairmanship of Additional Registrar of Cooperative Societies (MPD) for the purpose of purchase of decontrolled variety of chemical fertilizers by the Tamil Nadu Co-operative Marketing Federation, Thanjavur Co-operative Marketing Federation and Nilgiris Co-operative Marketing Society. The Government also directed to follow the procedures envisaged under the Transparency in Tender Act and the Rules made thereunder. 2. In the reference second read above, the Government have issued an amendment and appointed the Additional Registrar of Cooperative Societies(Credit) office of the Registrar of Cooperative Societies as Chairman of the purchase committee constituted in the G.O. first read above. 3. With a view to follow the procedures envisaged under the Transparency in Tenders Act and the Rules made thereunder, the Registrar of Cooperative Societies in the reference fourth read above, suggested to the Government to issue orders constituting the Tender Accepting Authority and Tender Scrutiny Committee for carrying out the functions assigned under the Transparency in Tender Act and the Rules made thereunder, in the place of the Purchase Committee constituted in the G.O. first read above. 4. The Government examined the suggestion of the Registrar of Cooperative Societies and in partial modification of the G.O. first read above, direct that the following committees be constituted: - 1) Tender Accepting Authority as a committee of procuring entities as per section 7(2) of the Transparency in Tender Act with the following members. (i) Special Officer TANFED - Chairman/Convenor (ii) Special Officer, TCMF - Member (iii) Special Officer, NCMS - Member 2) Tender Scrutiny Committee as per Rule 24 made under the Transparency in Tender Act with the following members.
5. The Government also authorise the above committees to decide on purchases of decontrolled varieties of chemical fertilizers, pesticides, seeds, agricultural implements, neem oil cake etc., for Tamil Nadu Co-operative Marketing Federation (TANFED) Thanjavur Co-operative Marketing Federation and Nilgiris Co-operative Marketing Society. In case the Tender Accepting Authority goes for negotiation, it should be done in the presence of the Scrutiny Committee. 6. /Forwarded by Order/ SECTION OFFICER (Orders of the U.S. on p 10 above) In G.O(Ms)No.264, Cooperation, Food and Consumer Protection Department, dated 25.7.2001 the Government have constituted a Single Purchase Committee under the Chairmanship of Additional Registrar of Cooperative Societies(MPD) for the purpose of purchase of decontrolled variety of chemical fertilizers by the Tamil Nadu Co-operative Marketing Federation, Thanjavur Co-operative Marketing Federation and Nilgiris Co-operative Marketing Society. The Government also directed to follow the procedures envisaged under the Transparency in Tender Act and the Rules made thereunder. 2. Subsequently in Government Lr.No.6667/CM2/2003-1 Dated12.3.2003 the Government have issued an amendment and appointed the Additional Registrar of Cooperative Societies(Credit) office of the Registrar of Cooperative Societies as Chairman of the purchase committee. 3. With a view to follow the procedures envisaged under the Transparency in Tenders Act and the Rules made thereunder the Registrar of Cooperative Societies suggested the Government to issue orders constituting the Tender Accepting Authority and Tender Scrutiny Committee for carrying out the functions assigned under the Transparency in Tenders Act and the Rules made thereunder in the place of the Purchase Committee constituted in the G.O. (Ms)No.264, Cooperation, Food and Consumer Protection Department, Dated 25.7.2001 4. Finance Department has remarked that it has no specific remarks to offer on this issue except any deviation from the Transparency Act, and requested this Department to follow the procedures as per the Transparency in Tender Act and Rules. 5. Now the Registrar of Cooperative Societies in his latest report dated 21.5.2003, requested the Government to issue orders constituting two separate committees(One for Tender Accepting Authority Committee and the other for Tender Scrutiny Committee) and also to issue orders authorising the two said Committees for the purpose of purchase of decontrolled varieties of chemical fertilizers, also for the purpose of purchase of Pesticides, Seeds, Agricultural Implements, Neem Oil Cake etc., by the wholesalers viz., TANFED, Thanjavur Co-operative Marketing Federation and Nilgiris Co-operative Marketing Society. 6. Accordingly a draft order is submitted below for approval. (Circulation does not seem necessary)
