ORDER:

In compliance with the orders in the references first and second read above, the Registrar of Cooperative Societies submitted the proposal relating to the special bylaw of Modakurichi Primary Agricultural Cooperative Bank Ltd., in his letter third read above for approval of the Government.

2. The Government, after careful examination, and taking into account the nature of business, volume of transactions and financial position of the Modakurichi Primary Agricultural Cooperative Bank, approve with certain modifications, the appended special bylaws covering the service conditions of employees of the Modakurichi Primary Agricultural Cooperative Bank Ltd., functioning in Erode District under sub-rule (1) of rule 149 of the Tamil Nadu Co-operative Societies Rules, 1988.

3. The Government, in exercise of the powers vested with them under Section 170 of the Tamil Nadu Co-operative Societies Act, 1983, exempt the Modakurichi Primary Agricultural Cooperative Bank from the provisions of Section 11 of the said Act and Rule 9 of the Tamil Nadu Co-operative Societies Rules, 1988, in so far as they relate to the adoption of the special bylaws covering the service conditions of employees and direct that the special bylaws as approved by the Government shall be valid and take effect from the date of approval.

4. The Modakurichi Primary Agricultural Cooperative Bank may, at any time, with the prior approval of the Government, include any new provision or delete or modify any of the provisions contained in this approved special bylaws so as to suit its special needs or local conditions.
